Hi,
I filed my 485 in Dec 2004.My PD is June 2004.
Got married in 2005.
If (Less Probability..) i get my 485 approved and not able to add my Spouse's to my 485.
What would be my Options.
Please advice.
I am no lawyer, but from what I know you can file for spouse's 485 until your own 485 is being processed. Once it is approved, you CANNOT file for spouses's 485. Trying to get your spouse into the US once you have a GC can take a very long time. However, the post above seems to have some different info. Follow that up as well.

I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?

Sorry you cannot claim. You have been a resident of GA, so rent/meals/commutation/laundry cannot be claimed as deductions in Tax return. You never had a home in NY/NJ. Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.

I have applied for my extension of H1B at Vermont Center. my first three years on H1b expired on Sep 8th. The application was filed on July 20th and it is normal processing. I have my H1b and H4 receipts with me, but its not yet approved. I am planning to take B1 visa appointment for my mother. Shall i send my mother to B1 stamping with H1B receipt.

My PD is Feb 2008 and my I-140 has been approved the same year. I am on my H-1b 3 yr extension.
If I were to change my job now, will I lose my PD or can the new company refile my new I-140?
Read somewhere in forums that one can retain PD as long as pervious employer does not withdraw the approved I-140.
Also I-140 is based of future job.... so no worries as long as you work based of your H1.

I am a software consultant on H1B. I have recently concluded my employment in California for client A and now I have relocated to GA where I am working for client B.
I have the following questions in this regard:
1) Should I do an LCA transfer to the state of GA from CA? + How many days do I have from the date of original relocation to do this transfer?
2) Can I do this paper work by myself or would I need the help of an immigration lawyer? + Any idea of what the average / approximate expense would be?
Any information with regards to this is highly appreciated.

You cannot. They only deal with your employer or its atterney in your case.
