Hi,
I was among those randomly selected for further processing in the Diversity Immigrant Visa (DV) program for the fiscal year 2010. Since I currently reside in the U.S., I filed Form I-485 ("Application to Register Permanent Residence or Adjust Status"). Upon having my biometrics taken, I had an interview with an Immigration Service Officer at a U.S. Citizenship and Immigration Services (USCIS) office. Because of a misunderstanding, I failed to bring to this interview an original Form I-134 ("Affidavit of Support") from a sponsor. Please note that my parents and sibling recently became U.S. citizens and are willing and able to be sponsors.
At the end of the interview, I asked the Immigration Service Officer if I can provide Form I-134 after the fact and he answered no. He made it sound as though a person gets only one chance at an interview with an Immigration Service Officer. He gave me a sheet of paper that had the following ticked off:
"Your case is being held for file review to prepare a decision. You will be advised by mail as to a decision on your application. No additional information is necessary from you at this time, however, if upon further review, additional information or evidence is required, you will receive notice in the mail. Please respond to any request in a timely manner. Failure to do so will result in denial of your application Please allow 60 days from today's date before making an inquiry on your case."
Questions:
1. Is there a way I can provide Form I-134 after the fact? If so, how?
2. If my application is denied, can I appeal the decision? If so, what are the chances of winning such an appeal and still finish adjusting my status before the DV program for fiscal year 2010 ends?

I have a valid H1B Visa which is expiring on Feb 16th, 2008 and my old H1 is expiring the same day as my Visa. I applied for my H1B extension my H1 extension is pending. I am planning to go to india on Dec last week and coming back on jan 7th.
1) Can I travel without any problems/
2) While coming back, what are the documents I need to show, will my old H1 is enough or do I have to show receipt of showing I applied for extension?

1. Even after leaving the company, is it legal for me to stay in the country and for how long?
As long as I-485 is pending or approved.
2. Can I look for any kind of job on EAD or there is any restrictions?
Technically, Yes. But keep a job offer(in similar occupation as GC labor) in hand
3. Is it possible that my former employer can cancel my EAD?
No, employer has no say on EAD/AP/I-485. But the original employer can cancel I140 and that in turn would trigger I485/EAD/AP cancellation. Use AC21 to avoid getting denial.
4. If I find a new job, do I have to use immigration lawyers of my former employer to help renew my EAD, travel document etc. from time to time or I can hire another immigration lawyer?
You can use any immigration lawyer, or you can do it yourself. I have renewed my EAD/AP myself last 5 years.

While quoting, discussing such links helps the members of this forum somewhat in keeping the buzz, I feel we must have focussed efforts on specific provisions that will improve the issues faced by legal immigrants. It is possible that this is easier to achieve than a Comprehensive Immigration Reform that this articles speaks about. Thanks to apnair2002 for the post.

Not a legal advise. My 2 cents.
I have never heard of employers pulling credit history to decide upon job offers. I have changed jobs when I had no credit history and when credit history was bad (in 500s) because of outstanding debt (no delinquency though), never had any issues.
Hi, I would like to change job but my credit history is so bad. credit score is in recovery stage. I was unable to pay credit card debt and worked with settlement company and settled all the cards..I paid every thing as of last month. But there were delequencies still appearing on my report..
I am working for a decent company, but i would like to change the job due to uncertainity and very less compensation..
It is very very urgent. Can some one suggest if there will be any issues that matters job switching. In general, will the companies pull credit reports and deny jobs based on credits...Will the credit history matters.. I did not had any foreclosures or bankruptsy.
Plz plz suggest..looking for a way around..

I sent my documents for I485 on May 4th. Fedex web site shows that the documents were received by the service center on May 5th. But so far, my checks were not deposited or I haven't received the official receipt. How long does it take usually for USCIS to deposit checks? If I don't get the receipts for another week, what do I do?

Hi,
Wanted to know if there is any limitation on H4B visa date for coming in to US. My wife's H4B visa ends on Sep28 2009, she will travel and will be back on 28th Aug 2009. Is there any problem since its only 1 month from expiry.
In the meantime I will apply for an H1b extension.

Thank you so much for your input .Right now I'm in a kind of predicament that my current employer told me in the middle of premium processing that he was hiring another person in my place.Then, when I spoke with my attorney he said we couldn't do anything in the middle of the process but to go ahead with it.I was approved for H1B 3 days after this incident.But, I have never worked for them since then and it's been a month trying to find another non-profit employer.So, in the midst of all this scenario, what would be the next alternative to be in the USA, how long I can be like this , I dont have a single pay stub, so can I show a reason that I was sick /or leave of absence when I find another job and include this kind of document with the peition or can do nothing for this period of time in the new petition.Could anybody please help me and Thanks in advance.

I have a PERM filed on Nov 2006. and it is approved. Like most ppl here I also applied for I-140 & I-485 during July and got the receipts. I am looking to change companies using AC21 by next Jan but would like to keep my H1B active.
I have the following qns:
a. If I find a new employer(B) who is willing to transfer my H1B, will I get extension 3 yr extension beyond 6 yrs based on my current employer(A)'s PERM and approved I-140.
b. I know that 3 yrs extension is possible with approved I-140. Is it possible with new employer also (the one who has nt filed ur GC ? Also Is 3 yr extn possible after filing I-485 beyond 6 yrs?
