Hi,
I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.
I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.

Seems like your end goal is to get GC, have you considered option of waiting for your son to become 18 so that he can sponsor you for GC? That might be an even faster option than EB2, considering the current backlog.

I am not so sure if the CIR bill will help us. Allowing 12+ million illegals into the same system that we are in will totally screw up our chances of getting green cards. Does the bill mention anything about increasing budget and manpower for the USCIS department to handle 12+ million potential applications? Considering that large numbers of the illegals are from a country which also has a specific country quota in the GC lines, will the bill increase drastically the number of Visa Numbers available??
This bill favors the illegals so much that even reading it makes me wonder how fair the system is to those of us who follow laws and file documents on time. What's the point? All of us should just forget about the rules and go do whatever job we want to do.

It increases the H1B numbers, it increases the amount of GCs availbale per year, it excludes dependents from the quota, it excludes STEM advanced degrees (currently employed as well as future students) from the quota, it does require the illegals to wait at least 6 years before they can file papers for their GCs and then thay get to be at the back of the line, additionally, if the SKIL bill provisions are also included as amendments, it will also provide a premium processing facility for I485. The SKIL bill also mandates the DOL to clear all backlog within 6 months. The thinking is that by the time the undocumented aliens (somehow, I do not like the word illegal) enter the pipeline, the current backlog will be cleared and all dates will be current.
Given, the uncertainity in the process right now, I still feel that CIR is the way to go. Also, if it were not for the issue of the undocumented aliens, there would have been no incentive or push to do anything about the system and we would be stuck with this system. As far as the USCIS efficiency is concerned, I would not underestimate them either, the USCIS is known to be very efficient when it needs to (prime example the spectacularly efficient and successful H1 B premium processing system) so keep the faith and help yourselves achieve your dreams :)

Is the use of EAD possible from 180 days after Receipt date or notice date ? I just crossed the 160 day mark, but I still dont have EAD. Can I use the requirement to use EAD(like a pending job offer) as a reason for Emergency to expedite my EAD, the uscis folks want some real reason to expedite the EAD application.

think about it if it was just paying a cut to the management to get your person hired wont ur competitor do the same. i have seen ppl getting caught because the competitor came to know of this and got really pissed and spread it around and the manager got screwed. most of the big companies have very strict policy for even gifts acceptance and the kind of gifts and amounts of it. i m sure it still happens but it can not be as widespread as ppl think it would be. which vendor to use is determined by someone really high up. most companies also keep a track of how much the primary vendor is getting out of the deal and there is a cap on it. they ask for the legal contract to check what % primary vendor is keeping so primary vendor cant fool the company and underpay the consultant and keep a hefty chunk for themselves.
all i can say is if you see a manager who is involved in illegal practice of taking kick backs expose that guy and get him fired it is your responsibility and it can be done.

All I can say is that everyone has their personal reasons for the decisions they make. This thread is information exchange thread for those who are looking to move to Canada. This isn't about why one should go one place vs another.
I welcome you to start another thread where ppl can debate whether they should move to India or consider moving elsewhere. In fact, I will be happy to discuss the options there. But I request ppl to not divert the focus of this thread.
Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.
The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.
My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.

I wish we can all send multiple emails to every newspaper, every tv station and radio station in this country and apprise them of our cause. such letters urging news orgs to cover our issue will help us get much needed media attention and then something will DEFNITELY happen in the coming months.

I have traveled out of the country 4 times since my last and only FP on 10/4/07. I had LUD on 10/4/ 07 because of this and have not heard anything from USCIS. I hope they still have my file somewhere in their warehouse.

but not once is the person posting the message declaring that he is leaving to India. He/She thinks that more "people from india will not come" . It is the person's ulterior motive that people from india should not come to US.
once i am in, let the doors close behind me.
Our attitude is playing one against another. We just need unity among ourselves.

Few months back, 2 DMV officers gave me a tough time in CT. I wrote strong complaint and got a reply that, it will be allright if I go again and I went for the 3rd time and got it without hasstles.
Here is what happened
Dear Mr. XXXXX,
This reply is in response to your email of 5/20/06 in which you
describe
the difficult time you have had in obtaining a CT license. Please be
advised that if the documents are not acceptable when you return you
may
ask the Sergeant or Supervisor to complete a form for 'Review of Non-US
Citizen Documents'. In this process copies of your documents are
forwarded to our Branch Operations Division for further review. You
will
be notified of the outcome by mail.
Thank you for taking the time to write and bringing this matter to our
attention.

I am a new resident to the State of Connecticut. I am on a h1b visa
(Skilled worker visa) and have been in the United States for 6 years.
My
employer is based out of Irving, Texas and I am employed fulltime with
them. My company sends me on work assignments to various clients all
over the United States. I recently started on a work assignment at
Pitney Bowes located in Shelton, CT. All this while when I am in United
States, I have worked in the states of Georgia, New York and Washington
and have obtained drivers licenses from all these states. I have
maintained legal status and always carry my documents whenever I
interact with a govt agency like DMV.
From the time I have started my work assignment in CT, I have
approached the DMV twice. Both the times I was turned back saying that
my documentation is not acceptable.
First experience:
DMV, Bridgeport, CT:
Issuing officer wanted a document from my employer that says that I
am still employed with them and have not switched employers. I asked
the
officer polietly if there is anything she is expecting to see in the
document (in terms of information like kind of work, nature of work,
place of work etc...) and she was very kind in explaining to me that
all
she wanted to know was if I actually work for the employer who holds my
visa. I told her that I will come back again with the letter.
DMV, Hamden, CT:
After obtaining a employment letter from my employer I chose to go
to DMV, Hamden, CT because it is close to my home. The issuing officer
looked at all my documents and then told me the employer letter was
unacceptable because it is generated by a computer. I asked him what
document is he actually looking for. He said he cannot accept a
computer
generated document. I was confused. Then he showed me my employer
letter
and told me he cannot accept it because it is printed from a computer.
I
told him it is generated from the computer so whats wrong with
employment letter generated from a printer connected to a computer. I
understood what he was trying to say. He just had concerns with the
validity of my employment letter.
Nothing wrong in having concerns about validity of employment letters.
He was just not able to express that to me. As I have the habit of
carrying all my documents, I showed all my legal documents like LCA
(that I am working in Shelton, CT) , my h1b documents etc... to make
him
comfortable of the fact that my employment letter is indeed valid. But
at this point he just did not want to listen or see anything instead he
kept arguing that this is CT and rules here are different and he would
not see any documents or papers and he only wants an employer letter.
And I told him that is right in front of his eyes. He says he cannot
accept it because it is a computer generated document.
Then I asked him what he really wants? He argued that he wants an
employer letter that is not a computer generated document but a actual
document. Then his collegue came to his resque and told me that he is
actually looking for a document that explains clearly the reason I am
in
CT and details of my work location from my employer etc... I asked him
to write it down in a piece of paper what he actually wants. His
collegue wrote down in a piece of paper that an employment letter
stating my work location as Shelton, CT is what they are looking for
and
I can get my out of state license transfer once I have that document. I
wanted a official letter from the issuing officer stating what they
really want and they were not willing to give me that. So I asked him
again what he wants next time. He said he wants a letter from my
employer that I am working in Shelton, CT and work details etc....
Dear Sir,
There is a lot of confusion over the issue with actual
documentation required. The best thing to do to check validity of h1b
visa holders is to actually ask for recent paystubs and w2 forms. These
forms have employer names and if any H1b visa holder. If the issuing
officer has concerns with documentation validity of a h1b visa holder,
then the best thing would be to have a employment background check done
or look at paystubs and w2 etc... Or specify what kind of letter they
are looking from an employer so that they can be convinced that the
candidate is a valid visa holder.
Though I will be going back to the DMV sometime next week with letter
they requested for, I felt it is my duty to suggest to DMV a good
source
of validity for h1b visa holders.
Dear Sir, Connecticut is one of the most beautiful states I have ever
lived and I am enjoying my stay in Connecticut. H1b visa holders are
skilled workers and we assimilate into the society while we contribute
what we can and work hard to maintain our status and are on a tough
path
to obtaining permanant residency.
Please treat my suggestion as a welcome suggestion and make it fair to
both the employees of DMV and non citizens as to what they or we can
accept and what not.

There is a lot of confusion over the issue with actual
documentation required. The best thing to do to check validity of h1b
visa holders is to actually ask for recent paystubs and w2 forms. These
forms have employer names and if any H1b visa holder. If the issuing
officer has concerns with documentation validity of a h1b visa holder,
then the best thing would be to have a employment background check done
or look at paystubs and w2 etc... Or specify what kind of letter they
are looking from an employer so that they can be convinced that the
candidate is a valid visa holder.
Though I will be going back to the DMV sometime next week with letter
they requested for, I felt it is my duty to suggest to DMV a good
source
of validity for h1b visa holders.

If both parents are Indian citizens, then the child is eligible for primary citizenship of India.
This is not true. The Indian citizenship rules were changed sometime in 2003 so that children are not eligible citizenship if the birth was not registered within 1 year or if the child has taken some other passport. These children can get Indian citizenship only after attaining 18 years and renouncing the foreign citizenship.
I think like many Indian government rules, the OCI rules have not been thought out properly.
