Obama has done something. He made sure that we are in this pell mall because democrats are not getting additional 12 million supporters. Had he been only 50% passionate towards immigration as he was towards Health Care, we as well as millions of others would have been out of this mess. Lets see :). I am expecting a surprise before 2012 elections.

If you really look at who is paying less and misusing the H1-B and L1 to manipulate the job market, its the big offshore companies who bring the less experienced folks from India/China and other asian countries into US. These biggies pay way too less (52 to 57K) to these folks than what the conultants who work for local consulting companies make.
They apply for 1000's of H1B's and L1's showing the positions in US but 60% of the folks works back in their offshore centers in China or India with H1B/L1 stamped on their passport. Question is, if they applied for H1B / L1 based on an existing position in US and gets approved, why is that folks are still working in India or China center? Doesn't that mean they faked the position?
When we consolidated the vendors and excluded all the local consulting companies to include only two of the big offshore companies, we have seen their consultants brought onsite leaving them after few months at our group to join local consulting companies for better pay.
To me, they manipulate the job market displace americans much more than the local consulting companies.
I truely hope CIS look deep into these manipulations and frauds as well.

How about tourist visa? you can get multiple entry for 10 years, but I guess no of months you can stay in India is a question. I am applying for my son too, both of us hold Indian passport, what you guys suggest? go for OCI?

Dear Nixtor, we should not question that when they do not have IV on their site and they do not cut us any checks. It is their site and they can architect it the way they can. Yes, the Indian Express misquoted Robinderi or may be it was a misrepresentation, we would never know but the good thing is that he has acknowledged the discrepancy. That is where it ends. Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.
At the end, time will tell if Immigration Voice would be successful in the agenda it has enbarked on, but what ever the final result be, our efforts would be analyzed for years to come by the ethnic, minority and national groups as to how to unleash the power of the Internet to build and run a grass root level oranization. Can you imagine how it would have been if Internet were available at the time of Mahatma Gandhi? I am sure Robinder has been thinking and analyzing that and we would welcome his analysis.

If any org all of a sudden starts giving us more credibility or negative publicity ( I am not referring to USINPAC here, So do not mis construe my point again) I will definitely take a moment to retrospect and see if there was a common goal. If there was a common goal indeed, why we have not worked together? I just pointed out the feelings some people on this side of aisle share. I threw them out there, while others chose not to. I just looked around and why any one is supporting now and not before. Hey, Never late than now. I, personally am more than willing to know why the American Indian Citizen community has always ignored this heavy weight issue, especially when the drums beat heavily on how to retain the culture.

I just dont get it. A.R Rehman has been doing amazing work for ages now and it needed a British movie to take him to the world stage. Really, his work in Dil Se...was way better than what he did in Slumdog.
Bollywood sucks and how!!! They need to figure out how they can take their cinema to the world audience. They've been failing miserably in promoting their movies in the west. Americans welcome change and encourage talent always and our bollywood producers/directors need to tap that.
films are made for markets, you and i might say that bollywood is shit but guess what 1.2 billion people dont think so and it works for them!

Bottomline is they do not want to give us Greencard just use us and fool us. I am sure this 485 being current is big melodramatic thing.
And it is only 1 year of filing I-485 ( can i take comfort that many others have been stuck 2 year, 3 year etc ). ANother reason why visa numbers got wasted is that many fellas got stuck in namecheck ( Ask many of the Indian/Chinese/Russian folks ).
I don't what crappy way they use to separate good from bad.

A lot of people seem to be saying this. It seems e-filing AP usually triggers a new FP notice. If this true then it will certainly delay things. We would be better off filing AP by paper.
What does everybody say?

I filed EAD by paper to TCS and got the "Card Production Ordered" email yesterday (in 14 days) for myself and my wife. My friends who efiled just received finger printing appointment notification and no receipts. Is there same benefit with AP? Please calrify.

Recently I met one friend. He was visiting his friend for vacation in New Orelans. When he was washing his hands in the rest room (in a shopping complex or Mall), suddenly he saw 3 or 4 guys surrounding him, hit him and took away his vallet and cell phone. Within a short time his credit card was used for a huge money around $2000. He was hit so bad that his nose bones broke into pieces and he has metal installed now for him to breath properly. I am not sure if this is due to bad economy or enemity over immigrants.
New Orleans was already in a bad shape due to Hurricane Katrina. Crime there is very high after what it went through. Anyway all these attacks have more to do with robbery ( or altercations ) rather than legal immigration attacks. The attackers don't care while attacking you whether you are here legally or illegally.

Everyone who changes jobs under the protection of AC21, must do so under the assumption that the sponsoring 140 will be revoked.
It is not a matter of our convenience. If you quit the sponsoring employer and he has no intention of hiring you again after your GC, then what is the sense in him retaining your 140 for no reason? It only adds complexity to some employers as dangling 140s are counted to evaluate their ability to pay. So even if it is not law, it makes sense for employers to revoke 140s of employees who quit them.
AC21 protects you from such a revoked 140. We have seen some cases where revoking the 140 - even after the 180 day mark - has resulted in 485 denial. This is a mistake from CIS and is easily fixed.
Expecting the previous employer to hold on to your 140 is not very different from expecting him to keep your you previous job open for you - just in case.

I only meant if you have the native country license already or if you can get it remotely. Leaving the US for the express purpose of getting you native country license would be an overkill...as you would agree :)

a) AOS pending

If nothing comes up...Check if your original employer files New I140 to consider you in EB3 instead of EB2 using same labor.
Even for that Nebraska expects a single source degree apart from 16 years of education for bachlores.

The requirements for the position shouldn't exceed SVP time levels for the job zone to which the position code belongs - that's all I know. If the position code falls under zone IV or V you can require MS.
I still don't understand how BS+5 qualifies for EB2. If the position code falls is in zone V, BS+5 (7 years of SVP) would be a "normal" requirement, but isn't EB2 only for people with advanced degrees AND positions that require the advanced degree?

Why don't we all campaign to ask for a time out on all immigration. Just stop all immigration until it is fixed. :D:D

We all know, Priority Date is not used for prioritising approvals. It is just a date on your application, which can stop your application from progressing further, if looked at, at the wrong time. Why not simply ask for approving in PD order.

A question to the people who used AC21 and on EAD:
I am on EAD and changed job (six months after the I-485 is submitted). The new employer - a well know tech company - insisted on sending the AC21 letter to USCIS, and I sent it. After sending the letters there were LUD's on I485 applications for me and wife and I assumed the letter reached the files. There was no activity after wards. Recently my wife went out of country and while coming back she went thru the AP parol process. The immigration officer asked her a few questions, one of them is where I am working. She mentioned my current company which made the officer to have a question mark on his face (the file he is looking at has my previous employer name). We were expecting this to happen and my wife quickly explained to him that my application was sponsored by so-and-so company (my previous employer) but later I changed jobs as per AC21. She even had a copy of AC21 rules with her. There was no problem but she was kept in waiting for another 30+ minutes until the immigration officer talked to 2 other officers. She got the impression that most of immigration people there are not really aware of AC21 and this made us think this could be a potential issue for those who used AC21.
Did anyone had any issues like this. We were lucky not having too much of a hassle but was thinking on how to handle these port of entry interviews if someone used AC21.

First of all, the letter is not a requirement when you switch jobs. It is a matter of personal preference on whether you want to send the letter. So there may not be any record in your file about the change.
I have travelled using AP. I was not specifically asked this question.
Now, all Immigration officers may not be aware of the AC21 law. It may be good to mention the law and wait for them to verify. From your example, looks like it is good for all the family members to know the AC21 law and maybe carry a document stating the law.
Its a good heads-up for some of us who have switched jobs to carry AC21 document.

I was in the same situation recently for the State of Iowa. My attorney called up the DMV and explained the situation. The DMV informed him that they would need the receipt notice from the USCIS. The license will be issued for the lesser period of the time range (if any) mentioned in the Receipt Notice that the USCIS expects to take to decide the petition. Upon receipt of the approval, the person will need to go the DMV again with the I797A form and get a final license.
Fortunately, I did not get to jump through the hoops as I decided to spend some hard earned money and got my extension approved by premium processing. Anybody else who has done something similar please post.
