Folks,
The "Time as Resident in a USCIS District" clause in the naturalization process says that "Most people must live in the USCIS District or State in which they are applying for at least 3 months before applying".
If you have gone thru this process could you please tell if this means that
a. the person must have stayed for at least 3 months during any time during of the residency period to be eligible to apply in that district
OR,
b. the person must live in the district for at least 3 months immediately preceding the naturalization application (for example, if applying in July 2010 then must be present in that state/district at least since Apr 2010)
The reason I'm asking is that I know people who live in India after GC and then come return to get citizenship...so wondering how it worked...

I am currently working on H1B and have received my EAD and Advance Parole recently. I am planning to travel next month and want to use
my Advance Parole for this purpose. When I come back (to avoid h1b stamping again in home country). Do I need to use EAD to continue

My Green Card was recently approved. But, due to retrogression I had not filed for my wife's green card.We did file her I-485/EAD/AP during the month of July. My PD is around 2003, and I dont see my wife's GC being approved very soon.
My questions are:
1. What kind of documents are required in the future? Lets say, I start a company and work for my own company. In that scenario, what are the requirements I need to fulfill to keep her application in good standing.
2. What happens if I go without a job for a few months(between consulting gigs). Does this adversely impact her application.
3. At the minimum, how do I keep her application in good standing, and be ready to respond to future RFE's.
I am not sure if these questions were discussed in this forum. I would appreciate if anyone can point me to any links.

It is specifically mentioned in the forms and online when you file for any applications that USCIS is unable to process any refunds requested by applicants regardless of an error in the application, withdrawal of application or an error on the USCIS's part. The wordings may not be exactly the same but in a nutshell they are saying "NO REFUNDS!!!"
I noticed it when I applied for EAD online and thought I goofed up the application and see what my options are.

EB2, officially known as "members of a profession holding advanced degree", requires a "Masters degree". USCIS views a BS+5 as equivalent to a masters degree for this purpose.

Hello all,
First some background:
I purchased a house this September and my apartment lease expires end of Sept. So I am basically living at both places and moving slowly. Anyway my USPS mail forwarding starts from 9/21.
As far as immigration and change of address goes, based on my lawyers advise...I filled out the online AR-11 change of address and also updated address change for my 485/ap/ead ( I am a july 2nd candidate) pending cases as well. However, after downloading the pdf version of the AR-11 I realized I misspell "Lane" to "Land." Don't know if this is a huge problem. Anyway can I re-file the AR-11 and change of address for all the pending petitions again for myself and my spouse? Does anyone have any thoughts or could share their experience? I read somewhere its also a good idea to update address with local office by getting info pass appointment? Any comments/ thoughts?
Also, in the AR-11 form I didn't provide email address, is that a big deal?

This visa has initially been sponsored by a company, so I can only work for this company
A lawyer told me that I could self-sponsor another o1 and then be able to work for as much company I want. I have an agent but he is not able to guarantee full time employment.
So I am wondering if I should do that or not.. What are the exact salary requirements for a self-sponsored o1?
I got a good folder, awards, recommendations and publications.

I sent my documents for I485 on May 4th. Fedex web site shows that the documents were received by the service center on May 5th. But so far, my checks were not deposited or I haven't received the official receipt. How long does it take usually for USCIS to deposit checks? If I don't get the receipts for another week, what do I do?

My wife is currently on H-1B status. Her employer has decided to close the company and cancel her H-1B effective from 2/28/09. My wife has an EAD and Advance Parole. We applied for her EAD and Advance Parole, when my company applied for my I-485 Adjustment of Status in July 2007. I wanted to know:
a) What steps are needed to move my wife from H-1B to EAD?
b) Do I also need to move from H-1B to EAD in order for my wife to use EAD?
c) Do I need to move my wife to H-4 status before she can start using her EAD?
In short I wanted to inquire, how to ensure that she is still in legal status after her H-1B is cancelled by her employer?
She will be in legal status although her H1 is cancelled.
Reason - She has file I-485 with you, so technically she is in AOS(Adjustment of Status)
When she finds a new job she will give her EAD details in the I9 form.
You dont have to do anything. You can maintain your H1.
If you convert her status to H4 then she cannot use EAD - meaning she cannot work being on H4.

I got a family based green card (through my father - F1 family based category).
My father lives in east coast.
When I entered US on immigrant visa at that time my father was in India for one month visit.
Before my father come to US I moved westcoast for Job.
So basically after getting GC I have not stayed with my father even for a single day.
Now I am planning to go to east cost to visit my father and from there we are planning to visit canada.
My questions:
1. Is there any requirement that after entering on immigrant visa(GC) I have to stay with my father (even for few days)?
2. For my Canada visit: What things I need to keep with me (except GC and Passport) while entering US (from canada)?
