I was returing after 3 weeks vacation from india and i went for stamping at new delhi adn got 3 years h1b ( this is my first h1b ext ). At POE officer was rude and he told me that he knew that I am not working as what my docs says. I gave him all letters and all that still he was saying that where did i get computer traning ??? etc.. I told that I have MS in Com Scie from USA but still he was rude and even I had valid stamp for 3 years he gave me only 2 years of I 94. when I asked how to get that one more year he simply said exit and re enter OR talk to ACS ( may be he means USCIS )..
so it could be true taht people may be turned back at POE.
Actually, he should have you I-94 for full 3 years. Is your passport valid for 3 years?

I agree that US has a LOT to offer and that's why we are all here. Infact everyone wants to come to US from everywhere
But I think your point 1 is a very loaded statement. For some people culture/parents/siblings might mean more than others. It may not have meant much when they left India but over the years they may have started valuing these things more? Is that good enough to make a decision? Only an individual can answer.
You are right that if immigration system were easier most ppl wouldn't be talking about going back. But that exactly is the breaking point for most ppl. Is the wait worth what you are missing by being away from your native land?

We are hearing reports from the Hill that Senator Schumer intends to offer a border security bill that raises revenue by increasing fraud fees for employers with more than 50 employees and more than 50% of their workforce on H-1bs and/or Ls (the so-called 50-50 rule). The fees would be increased in the following ways:
� For 50-50 L users, the fee would move from $500 to $2750 until Sept 30, 2014.
� For 50-50 H users, the fee would move from $500 to $2500 until Sept 30, 2014
This has high chances of passing unless opposed. While there will not be direct impact on some but the intent of the bill is to hurt High Skilled immigration. This is just one of the ways and we expect more. We have already posted details in the past about Durbin-Grassely or Sandars provisions.
Immigrationvoice is closely monitoring this and working on advocating against provisions that intend to slow bleed high skilled immigration.
This Politicians instead of making EB relief for all countries, and make everyone to apply EAD who has an approved I-140 , un-necessary disturbing, High Skilled Immigrants. The President is a mere spectator nowadays, he is more concerned with his re-election it seems, I know The President cannot directly involve in this matters, but he can do a Exectutive Order bypassing Congress to have Visa Re-capture.

Just a thought. So if the company would itself withdraw 140 after 180 days and after a person invoked AC21, then USCIS wouldn't look into I-140 (what's the reason revoking withdrawn I-140?). Wouldn't that work? If this works isn't it better for us to ask our previous employers to withdraw the damn thing and reduce our risks?

The aug bulletin come into effect Aug 1 2008.
If the visa numbers are available they may issue GCs instead of EADs for the applications they process now and that already been submitted during the Jul 2007 fiasco. Its not like they have to wait until Aug 1st to start approvals of GC.

What i see happening (If it happens which i seriously doubt) is that we might get a percentage of whole visa and that will just be enough to clear EB2 till 2010 as teh spillover rule will be followed. And after that happens all the EB3 will be told to try and port to better their situation or donate for another advocacy down the line in the future

Until now the Durbin-Grassley amendment has only been proposed when there is some pro-EB amendment also around (recapture/SKILL/increase in quota). This time I dont see any pro-EB amendment... or did I miss one? (the recapture one from Cornyn is already dead)

Anyone who stayed more than 183 days in 2008 here in US, must declare all their accounts in home country or any other country, if at any time, the cumulative value in those accounts exceeded $10,000. IRS extended the declaration deadline to September 23, 2009.

Now that everyone is current, I want to file AOS again as his derivative in EB2. (I have no hopes on EB3)
There is a question in I-485 (have you ever applied for AOS before , give date, filing location and final disposition")

yup...around 4 of my freinds have already sent the flowers..but they havent responded to the poll...(They arent even members of immigrationvoice.org...will ask them to join)
