I dont think people whoare bashing this have read Matloff's proposal. Otherwise they would not be asking for skil bill over this - this is way better than the skil bill.

As told by someone earlier, i suspect bigboy and his friends trying create panic in this forum so that many will call USCIS enquiring about this fake info and also thinking that the USCIS may eventually adapt this a solution ......sorry bigboy ..keep dreaming.. :D

There are so many other reasons for everyone and when i started this thread only for info sake , and i am the same person like everyone here. You shouldnt have applied 485 take a ride in boat and keep day dreaming that you have applied 485 in dreams and u got GC. If you guys dont like it let it be , i have not requested your comments when i started this , i said i want myself to be false to share info and as in like a community. It seems you dont want everyone to think of anything else.

if we want the recapture bill(or other logfren bills) to see the light of the day we need to get more people involved. If you have talked to your lawmaker then make a follow up call, talk to your companies HR/CEO we need to get more people involved. Just asking people to call might not work, why not get the 'right' people to call. The window of opportunity is small and the environment is messy. it also helps if existing GC card holders or citizens talk to the local lawmakers.
EB3 ROW is also screwed because they will also see the effect of the current visa allotmentment process. Make them understand the impact so they are become active. I tried to convince people in my company, HR is aware but ROW feel that this is an india specific problem.
I feel that major changes are not possible, why not target low hanging fruit. Finally only we can help ourselves (just see how many stop supporting us once they get GC or even think that they will get it in a few months). We can create strategic long term plans or use our meger resources for a quick fix, the choice is ours.
In the meantime, we are also discussing other options for help to EB3. Please let us know what we can do that we have not already to support the recapture. We will do whatsoever is remaining to be done.

Your lawyers delayed by a week or month, but a famous lawyer in San Francisco - Jackson hertogs, never did the paper work on time for me, leading to considerable loss in my GC processing.
Interesting.. I had a similar experience with a famous law firm in Seattle. They forgot to file my H1-B (in late 2000) and even went on to suggest that I can join the new employer as H1 has been filed. Since that law was new I was hesitant to do so. Later we found out that they missed my paper work when they relocated to a new building. But my employer stuck to them and started my GC (Feb 2001) with them - guess what? they lost my papers again and informed us 3 months later. My company then started my GC with another law form but by then I was hit by 245i...

For the people who wants to know what happened at Medical examination then here is my story.
Today me and my wife went to Concentra Medical center at Milwaukee, WI.
They didnt look at our ID but only asked for I-94. We gave our 797 form for current status check and I-94 both. Later Nurse took us to check our 1) Blood pressure 2) Pulse rate 3) did Skint test 4) took blood for HIV/STD testing. Nurse took around 15 minutes for each person.
Later Civil Sergeon came and started checking my body start with 1) hands 2) told me to jump for once 3) Raise each leg one at a time 4) Checked my Eyes, Ear, nose 5) Checked my heart beats and lungs from outside. Overall Civil Surgeon took 20 minutes for each of us.
Since I did not had any record of my earlier vaccination Nurse/Dr. Reccomend me to take Tetanus, MMR and Vaicella. For my wife Nurse recommend to take both Tetanus and MMR only.
Overall for Medical Examination it cost me $160 per person. Now I have option to take this vaccination at same center for Tetanus-$27, MMR-$67 and Varicell -$100.00 or I can call up County health center to get it done at cheaper rate.
Now Skin test result will come in 2 days. I can drop by on Thursday or Friday to know the result. If Skin test is positive then I/my wife both have to go for X-Ray which they charge $52 per person.
Overall it will cost me around $254(for my wife) and $354 for me to get this Medical paper signed and done. Hope above information will help others who are waiting to go for Medical examination.

yes I did mention to them... Not only job but medical reasons... But their point is once it goes in to Print facility those jobs are sequenced and cant be expedited. Congressman office gave them a call again.. they are doing their best... USCIS knows there are delays and there is some thing seriously wrong becoz most of demand of EAD's demand already gone. It might be attributed to some failure on ICPS during October after 8th through 25th and all the backlog is being pumped out now I still have 2 weeks hope it will turn around by then.
Since they have fine print of 30 days they are assuming that's their legitimate time to print and send out and they are covered.
Not to mention IV's help.

i have just called uscis and first they told we r not accepting any applicaitons b/w july 2 and july 17th mine was applied on july 2nd .she told they would have rejected my applicaiton bcos they r not accepting at that time but i told her still we dint get any application back after that she told me to wait for 30 to 45 days thats was she said.she dint tel any thing like visa numbers availability

Then get medical done here. The dates will be current till Ag 20th 2007. After that it is anybody's guess.
Take one bite at a time and swallow it. Else you will get choked.
She will get MMR, varicella, Tetnus, DTAP, blood test and lab reports done in India, the only thing left will be x-ray and skin test... wish she could get them done too from Indian Govt Hospital and then use them as record to get a quick certificate from doctor
i hope she does .... a little pain and small money will go long way i think ...

Just came on Dec 26th from HYD through LAX. At POI, no problem at all. Very smooth. Took finger prints, all ten fingers. Checked I-797, asked few questions and stamped & stapled the new I-94. The whole process took less than 5 mins.

We can keep blaming Mr. Durbin this, Mr. Durbin that. He won't change his views unless we motivate him to.
IV members in Illinois need to approach Mr. Durbin in good numbers and motivate him to change his position. Why do you guys think he's sympathetic to "undocumented"? They approach him everyday with their issues. He knows there are a whole "lot" of them in his constituency. He has a vested interest in seeing they become citizens, so that his future political career is strengthened.
Let's say 400-500 H1B GC applicants [ There should be thousands living in IL] approach Mr. Durbin - TOGETHER as IV members ; he will definitely listen. If that's followed by thousands writing regularly to him; he will surely do whatever he can do to accomodate "future voters" in his constituency - be it dropping some of the more draconian measures, softening his opposition to SKIL etc.
Right now, it's just 'Programmers Guild' , and other like minded labor unions, that have been talking to Mr. Durbin. They have probably been approaching him in greater numbers, through lobbyists, even making campaign contributions [ which we can't do].
There's also this wrong image in the minds of Democrats, especially those with labor backgrounds, that Highly Skilled Immigrants tend to lean "Republican". This also needs to be kept in mind while approaching Senators like Mr. Durbin. If I were to talk to him, this is what I would say
1) Foreign workers do not depress wages. Insufficient Visa numbers, the flawed GC process that takes years to complete and forces workers to remain with same company at the same position in a resricted salary range etc. keep wages depressed for Foreign workers ( as well as the whole job market). Measures that punish Foreign workers for the flawed Immigration laws is like throwing the baby out with the bath water!
2) Right way to tackle the situation is to improve Immigration laws to make the GC process faster by increasing the numbers, transparent, tougher laws against employers/lawyers that game the system and abuse the workers, remove anti-worker provisions and provide increased job mobility to workers in changing employers, getting promoted to higher positions.
3) Need to eliminate Country quotas that promote discrimination on the basis of National Origin. There is no basis for Mexicans, Philippinos, Chinese and Indians to be forced to remain at the same position, same employer, same salary for years; just because they happened to be born in the "wrong" country by chance.
4) Commend Mr. Durbin for proposed H1B/L1B whistle-blower protections. Commend him for a pro-Immigrant DREAM act and requesting him to extend it to kids of Immigrants waiting for the GC who face dire situations due to "aging out". Also express hopes that Mr. Durbin will continue to take up legislations that benefit the whole immigrant community.

I personally feel we should pursue independently of illegal immigration, as I have a feeling that CIR with illegal immigration issues will be dragged into the next presidential elections, it is too sensitive a issue for both parties. Does this mean If I file jointly with my wife who has an ITIN, I will not get any rebate ? Not even the 600$ for my SSN?
You will get nothing. If you like to avoid this you have to file separately.
In this case, you can claim your wife as a dependent on your return,
but the tax you have to pay is higher.
I checked this in my case: My rebate plus one qualifying child with SSN
gives $900 rebate. I would have to pay about $600 more tax and I will
loose one tax credit resulting in a win of only $100 in the federal tax.
However, I would loose more with the state tax which in this case
I would also have to file separately.

if yes, when was the FP notice mailed after AP RD?
I called the NSC and inquired on my AP statsu ( same online version story ) , but he said ,
"Did you got your FP done", " I will send a request to local center for your FP to be taken and should receive notice in 30days"
I said if IO needs it he will send me one, please donot send any request and it might create extra overhead in the process, the rep agreed and void the FP Request to local center.

Well I am confused with this new field. My case was RIR cases, and RIR was denied and converted to NON-RIR cases. So from last 4 years, for me, it was NON-RIR cases.
But today when I checked the case, it says Case Type: RIR. I have no idea whats going on.
