It applies to cases where you already have a approval for extension that starts after the day ur current visa stamp expires. So when u travel and at POE, the officer will perform the so called "last action" and stamp till the validity of your visa stamp. This "last action" is the current status of yours and will invalidate every other action (including the approval for an extension starting after the visa stamp) that was obtained before you travelled.

you have to apply for extension hope you got the passport renewed.
Visa stamp is for entry, I-94 determines the status and length of stay. Even if the stamp is valid if I-94 is expiring you will be out of status.
If you have filed for I-485 then your status will become AOS.

How do we know if you have 40 credits?
Where do we check or compute this?
It is very simple calculation.
Every year if you earn more that certain amount it becomes four credit. I don't know current amount, but it used to be very low between $5000 and 6000 per year. Usually people in computer industry might be earning 4 credits in first month (Jan) itself.
You can't get more than 4 credit in a year. It takes 10 years to accumulate 40 credit (basically it become 10 tax returns).
Low wage people earning less than $5000-6000 per year take more than 10 years to accumulate 40 credit.
Also this 40 credit need not be contineous.
F1 students and on OPT usually don't pay Social Security Taxes and so don't earn tax credit points.

i'm not campaigning for obama...... simply trying to set the record straight.....
the title of this thread implies that obama is not doing admin fix.... its not always about the campaign & votes, sometimes its about the truth and the truth is that republicans leaked the draft admin memo and wrote letters to oppose admin fix.... but now everyone here is blaming obama..... i'm simply defending the absent.....
most people pass judgments based on incomplete or incorrect headlines...... i'm merely saying that there is more to the news than just the headlines.... & this is related to immigration.... unless u think that the only valid immigration question is - when will i get my gc......

Not to belittle your suffering in any way, but when I saw this thread I thought it was someone being funny -- Asking that IV should fix the system, get everyone greencards AND start a service while they are at it! :D

Kufloyd: Did you also see a change in LUD on your spouse's (assuming you filed for dependent) I-485?
The reason i ask that question is that i am exactly in same boat as you are. Case was transferred back and forth between NSC and CSC and it's finally pending at NSC and i saw a soft LUD on my I-485 today, but no change on my wife's I-485. Do don't know, if there's a pattern to it?

It will be better if you use your in house staff for this. No need tp pay lawyer fees. Afterall its just a form. For straight forward cases, your staff can do all the documentation and I-129 filing.
Actually %age vs salary depends on your billing multiple. The % age may work out better for employees if overtime is involved and employees get to charge overtime unless you are paying overtime to salaried employees as well.

The only issue I see with using H1/H4 visa for re-entry is that if your I-485 is approved while you are outside US and you use H1/H4 for re-entry, it invalidates your GC and you have to start all over again. You either need to have your GC or an approved AP in hand when you re-enter US in this scenario...
That is not true. You should have no problem re-entering if you have a valid Visa or AP, even when GC is approved. Technically, you have to be first "admitted" and then the green card status takes effect. you have to show the IO at POE, the latest I-485 status if you have, which they can always check in their system.

Here is the same old Cockney reply from TSC on inquiry for my wife's case through my area congressman:
TSC is currently processing I-485 visas based on filing date order. There are a large amount of cases that are being worked and your case will be worked in receipt date order. With the limited amount of visas that are currently available between now and September 30, 2009, there is no guarantee that your case can be completed before the end of FY2009. It is estimated, that in general, your case will be completed between 45 and 90 days.
Thank you for your inquiry and please do not hesitate to contact us again if you have further questions regarding this case.
Obviously that logic is bull crap, otherwise I also won't have been approved. We have the same receipt date and everything...........I guess there is so much we can do....

my LUD for I-485 did not change since 8/28 even after my FP is done.
Today I got email regd EAD that the card production ordered.
called FBI Helpdesk and she told me that over weekend(sat 9/22) then have sent the approved file to USCIS. May be USCIS is lost my file somewhere.

gc_chahiye, Thanks for your response. So, can I be on H1 with my current employer, A, and on EAD with my new employer, B, simultaneously?
Also, employer B might be able to start me on H1-B (my preference--just in case)--though as you said, B will have petition my new H1 for concurrent filing. My other option, of course, is to wait until Feb '08--though I'll miss out on a month's salary from B (not a biggie in order to not have any potential issues).

This is just a humour but has a meaning underneath if you try to understand. I am comparing USCIS to a product selling company. If USCIS was a TV selling company what would happen to the customers the way it acts ?
You could buy a TV but you will not know when you will get it. It could be shipped the next week, the next month, next year or never.
The credit card will be charged once, may be charged twice or a valid CC may get rejected.
Somebody who buys a TV from USCSIS a 2 years after you do, he may get it sooner than you do.
USCIS has no way of knowing how many TVs have been ordered and how many of them are in stock.
In case you do not receive your TV in two years, USCIS acknowledges that there is a long wait time for some and does not do anything about it. USCIS thinks acknowledgment of wait time is more than enough that it has done for the customers. Customers did not deserve this but USCIS did a favour to them being a good "Customer Service" company
There would be an online survey after you buy it which would never get submitted 99% of the times.
In case it did get submitted, somebody will read one out of 10,000.
After reading it he will throw it in the trash can.
If you get a defective TV (which is quite likely), you have a chance to file appeal by paying the same amount of money for the TV again so that your case can be re-opened.

labor sub is not neccessarily always bad.
I have seen lot of folks who were stuck in a bad wait and only way could leave was to use labor sub.
Having said that, this case seems just bad situation..
Why couldn't he just check before he filed I140 if someone else has already used that labor?
It's easy to do...
Also why not just use I140 premium when it was allowed back then..
I am thinking someone got greedy and got conned while trying to con immigration system..

Sept 2001 PD'ers (if that is a word) can expect the PD's to be current this fiscal year. I somehow feel strongly about this.
