You might suggest its BS but i had a 30 min call with her , i explained how the process works etc. then she told me this is the latest rules they have . I want this to be BS too... but after speaking with her and confirming twice i value it atleast to make sure if we can do something. Also she clearly mentioned 4-5 times that NOT ALL APPLICATIONS WILL BE ACCEPTED. there will be many returns . if i hear this thrice how can i say i shouldnt read in to this.
I Don't think that they can return application back, that will be another lawsuit waiting to happen...but i am afraid that they might not process our application until new visa numbers are available again.

I assume that your three year diploma is from a State govt vocational school which hands out AICTE recognised (Same body which recognises B.Tech/BE) three year diploma.Fact that you went ahead and completed another three bachelors from same institution should add up and in fact , is equivalent to a regular 4 year engg. program.
In your post, you mentioned NIIT diploma which confused lot of people.Readers confused your situation with B.Sc+NIIT diploma people.
State govt /Central govt diploma from a regular polytechnic is completely different from private shops like Aptech/NIIT handing out diplomas.

IS there is disadvantage of filing 485 while my i140 is still pending in TSC. Fellow members advised me that I can file for 485 for me and my spouse with an i140 receipt and that its ok if the 140 is pending. Can someone advice on this issue.

Do you know what happened to pending labor certifications after PERM was introduced.same thing happens now also.
If I remember correctly, It was announced ahead of time that PERM would go into effect (I think it was March 29 2005) and all old style labor filings would stop from that date. But, in this case, they are using a date that has already passed, without giving the people who are in queue for 4-5 years due to the BEC /labor dept ineffiencies, as a cut off date. Now, those of us who have invested 5 years of time hoping to see the GC someday soon, have to wait until Oct 2008 . It gets complicated because of H1B extension issues that wont be available unless you are on the train that left on May 21st.

Does he mean there are more pending applications? If yes, how many and does he have separate data we do not know?
He said that category is rather low priority for USCIS, and therefore it is highly unlikely for it to be approved before 3 years, although it's entirely possible.
I'm hoping he's wrong.

Finally AP got approved after 104 days from NSC.
E filed AP on May 5th
Approved on Aug 17th
received docs on Aug 23rd
well its actually 110 days between may 5th (date of filing and you actually receiving the AP on hand)..

You are right -- I was thinking of filing again but separately. I just redid my calculation with that in mind and found that I will be actually not gaining anything, in fact losing. However, just to be precise I believe I can count my wife as a dependent since she has had no income and she can not be claimed dependent by anyone else. But yes my standard deduction comes down by a lot and that hurt me.

Which means Oct 1 of the year after this bill is signed by the president and not only passed in both house and senate. It actually maynot be the signing date if the enactment date is different.
I think we are unduly worried about this May 21st, 2007 date. For all we know this date maybe something like Oct 1, 2009 or even later. Which is plenty for people backlogged assuming all labours are cleared by this september.

If I have H4 and start working on EAD, I lose H4. So even though I am eligible to work, I cannot as I lose my status (status violation) and become deportable. Nonsense. The INA was written with the assumption that any petition will be adjudicated in 6 months. It it was the case, the memo would work. But reality is very different.
Another point. We are discussing about a USCIS memo.
USCIS is a department operating under US government. USCIS director cannot issue a memo that contradicts INA. If the memo contradicts INA, the memo is invalid.

I would like to add here that I really thank IV Core members for having taken this initiative, It is not easy to take up such a huge cause and try to drive it to completion, just look at the state chapters so few members have signed up and are taking an active part, we are the people who are responsible for making this happen and we should take active part in the efforts to achieve our goals.

Yes that is a pretty known fact that people have been given 221(G) slips and made to wait for 3-6 months by consulate. I know a friend who had to undergo name check clearance that took 4 months at Ottawa consulate. He came back to US on parole and after 4 months when they approved his visa he again had to go to Canada get stamped and return on H1. It was a hassle but least he had backup parole that helped. But he did not face any issues at POE for this.

It looks like if your case is clean and qualifies based on current PD,they are selecting randomly.I dont think they are going by any calculation of RD<PD,etc.Its plain if your PD falls in current category and they pick your case first even if its June2006,yr case might get approval..
WOW ,this is a bizarre way but at least ppl getting approved & visa numbers not getting wasted,so ok...Anyhow too early,maybe we start seeing some trend in next few days.....So lets keep guessing...
