By somehow discouraging employers from hiring H1B/L1s they want to restrict the high-skilled immigration program. It is not just about one provision or how many people it affects. The fact is such provisions will make it difficult for future and present immigrants to stay in the country. This is what anti-immigrants want and IV and our coalition partners in Compete America will oppose it.
H1B is technically supposed to be for highly skilled workers, when a match to the job requirements is not found in the US. In the context of "must hire h1b" as this clause relates to
a) Would a company not hire some one and do not get the job done?
b) Is the cost so prohibitive (increase of 2250) that an employer cannot make any money if they pay the additional fee? In other words, is the employer not making enough money on a H1B to pay the fee? If so, hiring a H1B may not even be worth it.
Alternately, if on the face of it, increased fee encourages employers to find more "domestic" people who match the job specifications, and the intent of the bill is to precisely encourage such behavior what's wrong with it?

No doubt the industry lobby is verrrrrrrrry strong. But the AC21 measure also allowed employees to change jobs; not sure if that was entirely in their interests.
In any case, tying our fate to H1B is not a wise thing to do. The house will reject it one more time. They simply don't want the H1B increase. What we saw last year is an increase of only 20K for folks with advanced degrees in spite of the industry lobby working so hard. The industry lobby would have liked many more H1Bs. They don't care for the green cards or the plight of those trapped in the process. I have heard a top exec from a top tech firm say that after they finish their 6 years on H1B, they are welcome to go back! Actually, many prefer it that way. Alterego, you've pointed out correctly that the industry cares for NEW workers.
If anyone is seriously thinking that the industry lobby will (in the lame duck session maybe) sneak in an increase in visa numbers in a bill that asks for more H1B, he/she is in a state of delusion. Had they been that concerned about the issue of retaining employees, they would have asked for higher visa numbes when they lobbied succesfully for an increase in H1B itself during the Clinton years.
IV's is on the right track. It may take time to get them to understand the difference, but it is achievable in a year or two. What is also likely is a temporary increase in visa numbers; this was done some time back, and we should have no problems with that.

In addition, when the budget bill was passed last year before IV was formed, who do you think tried to add in all those provisions for recapturing visa numbers, excluding spouses from the count and so on? Try to get your facts in order before just posting.

If you want to import labor just to take care of your kid, and do it legally and ethically, paying proper wage, obeying local labor laws, getting proper paperwork, sure, you can do it. But you have to be seriously rich. But if you have that kind of money, you'll get a lawyer to answer these questions about how to go about bringing a maid here. You will not be posting it on a web forum.
Bottom line, if you are the kind to try to save a buck by posting questions about complex legal issues online instead of hiring a lawyer, it is extremely unlikely you are going to paying anything like proper minimum wage to your maid. Getting someone here on what would amount to basically bonded labor is not just very unethical, but illegal.
I'll be honest - If I see my neighbor or someone I know doing it, I will not hesitate reporting that person to the authorities.
And by the way, invoking "motherhood" is rather silly. Millions of mothers here, both American and immigrant, raise kids successfully without having to get a bonded laborer from a poor country to do the washing and cooing to the baby while the 'mother' stretches her leg on the sofa.
If the hubby and wife cannot pitch in and do their fair share, perhaps you are not ready to take up the responsibilities of parenthood.

Dont do the mistake of committing to a Masters program if you don't want to get a Masters Degree. Some of them can be gruesome (not that they are very very challenging, it can take a toll on your work and family life) I mean dont enroll in it for the sake off EB3 to EB2 switch. EB2 India is pretty much jam packed as EB3. Check the 2006 Perm statistics from flcdatacenter and figure out how many are in India EB2.
If getting a GC is your issue, solving the retrogression is your solution. There is no shortcut.

It doesnt affect me, but I'm willing to support any effort in this and I'm sure this is a very very genuine case and will get approval from any law maker who is supporting DREAM,
IV Core, we need your help in this. Can you please come up with an action plan. We are willing to fund the cause if you come up with how we go about this. We know its not just money thats needed but a campaign type effort and I'm sure all the parents and their kids will come out in support. Too bad that these kids have to now suffer..
Thank you very much for coming forward, there are thousands of young adults who would benefit from a concerted effort if this bill were to include them and get passed.

You should also call the references they provide. All states have a 'Offenders in your area' website, where you can check for that person.

YMy understanding is if anyone has EAD and working or looking for work by using EAD will not accure unlawful status. All others (particularly H4 dependendts without EAD) may be accuring unlawful status.

Couldn't agree with you more... I am just attributing imv116`s post to ignorance about the whole polytechnic + 3Yr B.Tech degree course of study.
On a side note I am assuming the associate degree given by colleges in the US is the equivalent of the diploma issued in India. So I am sure any educational evaluation agency would not have any issues with declaring Polytechnic + 3Yr B.Tech the equivalent of a 4 Yr B.Tech.

Please clarify from a poster first before posting a judgement on anybody.
To me, whoever doesn't clear an entrance exam in India doesn't deserve to be awarded a regular B.Tech degree. That would rule out all of Maharashtra colleges. (In mid 90's .Maharashtra was only state in India which would give admission on merit basis,whereas in Rest of India ,even if you get 97% in CBSE, you are not eligible for BE degree anywhere)
Some one from IIT/MIT/Harvard would rule out everybody who has not done a BE from these premier institutes.
But of course, my biases and personal prejudices irrelevant while answering some one's questions.When we enter professional life, only thing which matters is technical and communication skills.
There are better programmer from 3 yr B.Sc + NIIT Diploma pool than some one from IIT Mechanical Engg pool.
So What do you do?

On a side note I am assuming the associate degree given by colleges in the US is the equivalent of the diploma issued in India. So I am sure any educational evaluation agency would not have any issues with declaring Polytechnic + 3Yr B.Tech the equivalent of a 4 Yr B.Tech.

Please clarify from a poster first before posting a judgement on anybody.
To me, whoever doesn't clear an entrance exam in India doesn't deserve to be awarded a regular B.Tech degree. That would rule out all of Maharashtra colleges. (In mid 90's .Maharashtra was only state in India which would give admission on merit basis,whereas in Rest of India ,even if you get 97% in CBSE, you are not eligible for BE degree anywhere)
Some one from IIT/MIT/Harvard would rule out everybody who has not done a BE from these premier institutes.
But of course, my biases and personal prejudices irrelevant while answering some one's questions.When we enter professional life, only thing which matters is technical and communication skills.
There are better programmer from 3 yr B.Sc + NIIT Diploma pool than some one from IIT Mechanical Engg pool.
So What do you do?

bigboy007: I definitely agree with your suggestion and i will do my best to contribute. I plan to letter to Ombudsman and my local congress addressing issue with renewal EAD, delays in GC and impact on us. It may or may not help but every step we take will hopefully help all of us toward the goal. I am new to the IV action list - i plan to spend sometime and contribute as much as i can.

Second Labor = 2004 (Employer told me he was going to apply for EB2, Lawyer applied for EB3, I have masters in computer science and have 14 yrs of experience in Database Technology. Published white papers. Wrote articles in oracle magazine. Still in EB3.)
