I am sorry to hear you aged out. I understand more than you think though as I am the parent of a child just like you. We have no idea what road he will be able to take and in which country.

The DREAM act will not cover you. I have checked and double checked the wording on the different versions. You and your family have done things legally and will get nothing from this legislation.

I also wish this forum would take note of this problem but do not hold your breath, I always get accused of hijacking things whenever aging out gets mentioned. Sadly I think there are just not enough families suffering for anyone to actually care, except those it affects.

My local senator is one of the co sponsors and I am attempting to get him to take my plight on board and realize that rewarding those who came here illegally and ignoring those who have followed the rules is simply morally wrong on so many levels.

Try contacting your local senators too and feel free to send me a private message via IV and maybe at least two families can be in touch and see what can be started.

This guy's priority date is later than mine, but receipt date is 13 days before mine!! Sounds like this approval is pretty random

Looks like there are 2 ways to process...

1) They pick all cases whose PD is current... Sort them in RD.. and start adjudicating the cases with earliest RD...

2) They pick all cases whose PD and RD is current... Sort them in PD.. and start adjudicating the cases with earliest PD...

1 seems to be the case with NSC and 2 with TSC :-) so far...

Hope they don't waste any visas... sooner or later, I'll get my fair share too :-)

1. They had to post the 485 pending list sooner than they anticipated because USCIS "one up"ped them by posting the info on their website and hence they were not able to play "God" with that info anymore.

I have a 3 years Engineering diploma plus a 3 year Engineering bachelor degree. We were given an advance standing in B.Tech (4 years for people with 10+2) and we completed it in 3 years. So it is 10+3+3 = 16 years of education. (I am from India)

My Attorney thinks this might be a problem at NSC at I140 in EB2 because of a 3 year degree. But it (B.Tech) is in fact a 4 year degree, and we were allowed to finish in 3 years. After 1 st year we attend the classes with 3rd year students of 4 year program. Take same courses and same tests.

How can I convince my Attorney and TSC that it is equivalent to a 4 year BTech degree in India and equivalent to US bachelor degree ?

I guess confusion arises from the fact that NSC does not recognize a 3 year BSc+ PG diploma from NIIT as equivalent to US BS degree.


Edit : My education evaluation was done by TrustForte. Are there any other evaluators that are more familiar with Indian Education system and also trusted by USCIS ?

This is in particular reference to the Volunteer recruitment drive. I totally agreee with the IV core group that they alone cannot and infact should not be the flag bearers for this problem. It is our (all registered members) onus to solve this along with them.

I am from Washington State and I have been constant touch with some of the team members. They have helped formulate our strategies.

What have we acheived in Washington
1. We have generated a core group in Washington with about 7-8 people in it. We have an informal structure but most of these people have accountabilities and goals and we meet once every week.
2. We have generated fair amount of awareness among people in the state regarding Immigration voice and its impact on our lives.
3. We have posted IV flyers in most Indian and Asian grocery stores and restaurants.
4. We are in the process of setting up meeting with Senators/Congressmen.

I strongly encourage everyone interested in solving the retrogression issue to join the Conference calls. You will be amazed at the wealth of information california state and IV core group has.

2 crores is what one needs to go back to India

i have been having this discussions and i guess even a crore in either FD (fixed deposit with 8 %) would fetch 65 k rupees a month

which is more than what a Middle level manager gets in India

And looking at the rate the prices are going up (for real estate etc) , you may have to revise your estimate evry day. My point is there is no "one size fits all" decission.

Hi:

PD 2001

My Hr got the cover letter showing my labor approved by email from dallas BPC. My lawyer does not seem to have received the whole package yet(no idea why lawyer don;t get the packages on time). I have no clue.

But my HR asked Dallas BPC officer and she said that cover letter was enough to file for I140and plus I485(concurrent)

The cover letter is part of the whole approval package.

No...I don't think the cover letter may not be good enought. Most lawyers won't even file.
I got the hard copy two days after I recieved the letter...so you should be getting it anytime now.
When was your labor certified online? If you don't receive it by end of July, go ahead and file with that letter and try.

Well, the situation in the STEM area is dire indeed. Very few US citizens are entering the field and majority of graduate programs in the US are run with a majority of foreign students. A large number of these students had to go back after their 1 year OPT and the rest went in for another graduate program to wait out for the next year's H1B quota. Most industries are now screaming that they can not find enough engineers and scientists. On the other hand other western countries with skilled immigration programs are going to make a killing. So the SKILL bill and other such legislative measures will be out of dire need for the US rather than a lobby pressurizing congress. As far as retrogression goes, it may not be a high priority - the way congress looks at it, well these people (who have filed 485) are in the US, working - they just have to wait out for their visa numbers. I don't think the majority of Americans or congress understands the 485 process including the ability/inability to file 485 due to retrogression. Stories of those who ran out of the 6 year H1B limit needs to brought out to highlight the plight of these people.


Lobbying is a part of life here. Those industries that so desperately need engineers and scientists will eventually lobby for higher H1B quotas.

It is taking a lot longer than the last couple of years. I filed mine end of June, normally TSC would have approved it by now. Unfortunately this time it was transferred to the evil NSC and I am still awaiting an approval.

I filed my AP renewal in end of May (NSC) and still waiting :)
