All,
My wife and I applied for EAD together almost 110 days back. My EAD came through within 60 days but no signs of any progress on my wife's EAD.
Are more of you facing the same issue? We called USCIS and the officer expected another 3-4 month delay.
What are our Options? I thought USCIS had a commitment to send out EADs within 90 days! Any idea why the interim EAD thing was dropped? Any exceptions under which they actually give interim EADs?

I think we should wait for the lame duck session to finish, to make any predictions. Because if there are any new last minute stunt on anything non-immigration, then for the next 6 months or so for the new house, they will be discussing this new stunt. Immigration will take the backseat.

I wonder what the possibility / probability is that the dates will become current just like it happened in 2007 in the last quarter ... ofcourse USCIS will not give away green cards to everyone (except to few lucky ones) ..instead they will get tons in revenue and this would make the lawyer lobby happy too ...

FYI majority of Desi companies follow the rules as stipulated by US laws. There definitely are abuses in any law. Do you think all wallstreet firms played by rules in this financial mess.

Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. Yes GC/EAD gives to room to look around / negotiate the higher rate , to sustain and move up will require a lot more than that.
Look at the aveage compansation for any area.
Assess your expertise ( not to compare with you the guy sitting next to you)
Try to move up in the ladder
Keep updating your tech skill
Diversify to more ( but related ) skill.
Add niche like PMP / Six Sigma.
Top of all , little bit of Luck , to be right place at the right time .

Thank you for all quick replies.
It's been about an year the case has been closed. I can't expunge it for 4 more years. The attorney said it may not be under CMT. I think even though we expunge it, in future where ever we go, if asked that ever got arrested, we need to say YES right?
My attorney says it should be OK.. I am not sure what to be done as you said it all depends on the VO

In Ohio expungement can be done after 12 months and I neither know which state you are in nor I know the rules of any other state. The best bet is talk to a good criminal attorney. You are stuck with this case for quite some time and u need to talk to a good attorney.

I find it hard to digest why would they mind if some one has been to India recently?
Does this argument apply just for the indians or does it apply to individual of any nationality?
Because, we (asian) still have eradicated Diseases in spread. This not is only applicable to India, for mjaority of Aisan countries too.

I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

Look, the H1 quota was not sufficient even when it was set at 115,000 pre-2000. It was only when it was set to 195,000 in 2001 that the quota exceeded demand. Now thanks to the report by USCIS last year, we know that about 20% of the H applications had fraud or technical violations. Even if you assume that the USCIS does a perfect job and catches this 20%, the quota that will be freed up won't be enough for the rest of the applicants.
The issues we face have less to do with fraud and more to do with the anti-immigration forces who dislike the 1965 immigration law. Claiming fraud, cheap labor, harm to the environment from increased population are just convenient means to couch opposition to permanent immigration in.

I have purchased 4 firearms during my nonimmigrant status, including a handgun. Nonimmigrants can generally not own firearms in the US. Though, there is an exception to the law if you possess a valid hunting license and have resided in the US for more than 90 days. I took a hunting class, which was a prerequisite for the hunting license and also had very good firearm safety information.
For long-guns, you will need some paperwork before you go to the gunshop (utility bills from at least last 90 days, hunting license, Driver's license, your I-94 number). The background check will probably be delayed a day or two while FBI checks your immigration status. Your gun seller will call you when they get the ok.
For handguns, there may be additional paperwork. I had to apply for handgun permits with the local sheriff's office. The person you first deal with will probably be unaware of the exception for individuals with hunting licenses. You will probably need to take a copy of the law (ICE has a pamphlet on firearm laws for nonimmigrants, take a copy with you) and talk to a supervisor. Once you get the permit you take the permit and your DL to the gun seller plus all the paperwork I listed for long gun purchase. Let me know if you have additional questions. Good luck.

Btw, if the visa bulletin is not out yet, its a good omen. Over the years it has been observed that whenever visa bulletin comes out a bit late, like between 13-15 of a month, it moves the dates quite a bit forward. The bulletins that come out early in the month, like before 10th day of the month, truly sucks.

1) I downloaded the form G-639 from USCIS website just now , after briefly going thru it seems like just I-140 approval copy should not go above $25 , may be less. However much complicated requests will add higher costs.
