If your LC is approved before July 31, you could submit your 140/485.
My company is currently filing PERM...should my PERM get approved in the next month, would I still make it to concurrently file my I-140 and I-485 before dates potentially retrogress again in Septemper or so??? HELP guys!! Thanks!!!

My research
------------
1) After careful research what I concluded if you have record for MMR for an
adult then during medicals you will have to just deal with HIV and TB
test and perhaps Tetanus.
2) For an adult if you do not have vaccination record then there is one medical
test named "TIDER" test through which you can establish whether your
body is immune to MMR or not.
3) If your primary physician "recommends" you to have tider test then
insurance company will pay its cost. Once TIDER establishes your MMR
record good then you do not have to get MMR done at USCIS's designated
doctor's office. They will accept this TIDER test result
Action:
--------
- Called an insurance company and it said "NO", it does not cover vaccination
tests
- Make a call to Primary physician and have appointment for " Blood and Urine Test-
TIDER Test"(Did not utter the word "Vaccination" - It is important not to utter "Vaccination" .. Don't ask why? -- Some questions you just do not ask.. you just do as you are told to do)
- TIDER done and picked up results from Dcotor's office after 2 days.
- At some point of time fix USCIS Doctor's appointment and produce TIDER Test result alongwith 693 form and vaccination forms. Doctor accepted it. DOctor's Final notes on 693/vaccination form was immune to MMR based on " Test lab report ..so and so...)
Total cost per adult was $ 91/- per person for USCIS Doctor's appointment and no cost except $ 15 copay for previous TIDER. Our TB test was negative so we did not have to go through X-ray. But X-ray would add only $ 20/- extra. But If I might have gotten my MMR done at USCIS's Doctor , It would have added at least $ 150/- extra per adult at same Doctor's office.
If you are not in hurry and can work this out try it. At least it will save you some bucks.

You're not delusional at all. But your intrepretation is incorrect.
First, get yourself another beer. Second, take a sip... naaah, bigger one. hmmmm that's better, now read on...
Effective date will indeed be Oct 2008 (if it becomes a law that is). So if your GC process is OVER before then, you'll not be affected by anything in this bill including the I-140 filing cut-off of May 21st 2007.
But if you don't have a GC on Oct 1st 2008, the law will check whether your I-140 had been filed by May 21st 2007, if not, all your approved & pending applications etc will go down the toilet, doesn't matter if you are a day away from approval on 10/01/2008. You start fresh and file a new merit based application.
Now bottoms up and get another beer. Then one more on me.
Ok..Thanks. Now, I am drinking that one more beer (on you!) and chill out...Tomorrow is another day....

I have my i140 pending in TSC since Dec'2006. On the USCIS website, it says that they are processing receipt dates till nov13 2006. My RD is dec 11th 2006 and my PD is oct 2006. As the PDs have become current for EB2, can I still file for my I485, even though my i140 is still under process.

The fax and letter links you included are all supporting the ilegal kids dream act. If we just fax and send letters through these websites, we will just be counted among the many who just support the dream bill. However, what we need is for people to phone the senators who authored the dream bill and also other senators who might likely get this bill passed. we have to highlight the issue faced by young high school/college graduates like I_aged_out.
This issue has to be raised seperately and clearly from the dream act. What I mean is; just by supporting dream act will not help. They will not realize that we are talking about kids affected by the BACKLOG AND RESULTANT AGEDOUT SCENARIO.
Now how to do that? Personally I have no clue. Hopefully some clever IV member could take a lead and tell us how to attack this issue.
Let me be clear:
we are achieving not only a benefit for the affected kids but also highlighting the problems faced by the EB community due to visa number wastage and the backlogg. This is indeed a rare opportunity for EB community to put out its issues before the law makers.

Hi Pappu and Admins.
Thanks for the good work.
(*based on data from USCIS)
Your position is 3686 in the Green Card Queue based on your Country of Chargeability "India", Priority Date "Feb-04" and Category "EB3" .
Your Expected Date of Adjudication is Jan, 2011.
(*based on data from USCIS website September 2009)
Result for patiently_waiting:
Your position is 24486 in the Green Card Queue based on your Country of Chargeability "India", Priority Date "Feb-04" and Category "EB3" .
Your Expected Date of Adjudication is Jun, 2018.
*******************************************
I can understand how the tracker gave 24486 (based on pdf provided by USCIS recently).
How the tracker arrived at 3686 based on my priority date ?
Can someone please explain ?
Thanks a lot.
Here is the part the math doesn't make sense to me, I ran the tool with IV data and I have 4639 people ahead of me in GC queue (my Priority date is Mar-06 EB2 India), and when I run the tool with USCIS data, it says correctly ~ 21953 folks ahead of me. Looking at the USCIS published data on there site (which is posted August 25th 2009, and probably doesn't include the recent approvals), there are approximately 7000 EB2-I cases pending till January 2005, which is where the visa bulletin cut-off date is. Assuming all 7000 cleared in September 09 and IV data is the most recent, there should be at least ~15000 ahead of me!
I do not understand how the 10000 or so 2005 folks are missing form the IV data, when they were never current between USCIS published data and IV procured data.
Can someone shed some light?
Thanks for the good work.

All,
Now I am confused completely. Do we need a transit visa to travel to India or when we are coming back from India. This question is asked irrespective of the new rule (if it is changed or not)

I doubt that USCIS gave us any additional information beyon what you would see on their website by tomorrow anyway!
So hang tight for one more day and you will see it all on their website.
By the way, I do personally believe that it would be only fair to include all the FOIA donors in the information sharing by IV, but it's just a personal opinion. Different people may have different views on it.
Just chill....
As predicted, here is all the much awaited info!!

I doubt that they provided any additional info to IV (as FOIA response) beyond what is there above...

Center for Disease Control (CDC) USA – Oct 2006 to Sep 2007
Recommended adult immunization schedule
Vaccine – Age Group – Dose(s)
TDAP- (all ages) – 1 dose Td booster every 10 years
MMR – (19-49) – 1 OR 2 doses
MMR – (50-64) – 1 dose
Varicella - (19-49) – 1 OR 2 doses
Varicella – (50-64) – 1 dose
Straight from Horse's Mouth (http://www.idph.state.il.us/about/2007adult-schedule.pdf)(the CDC link (http://www.cdc.gov/Nip/recs/adult-schedule.pdf)is not working):
I just noticed when I had applied for under grad program here it required a medical form filled and certified by a dr. That form stated the US requires MMR to be given atleast twice in a 12 year period. Does anyone know if the same applies in this case?

Some Indian companies also reason for this. They never recruit Gc holders or citizens because they have to give more pay. Past 2 years they started taking GC Holders and Citizens as demand is more than supply. If you see 1990s till 2000 there was not a big oppostion to H1Bs. Now you can see the difference in recruiting policy of some companies. Lot of companies are recruiting H1Bs for cost cutting as one of the reason. But Back in 1990s they were recruiting only because people were not available for jobs and they never lay off just for outsourcing. There is no wonder in oppostion when companies lay off existing people and and recruit 30% by H1B and 70% offshoring. If government can give some protection or regulation then oppostion can be weakned. There is already some protection like LCA but that never gave any protection. Also in India more people got excellent skills because of outsourcing they are waiting to come here even 200k will not be enough. That is the reason now they started asking exemption for MS people for H1. H1B numbers should be based on demand and supply not because of Cap reached. That will keep for sustained immigration. Of course extradinary persons should be given exemption. If unlimited H1B is given that will increase supply and that is not good for current H1Bs also.
Some of the old reps are scared of touching the H1B issue, which is tied to EBs, because of how the media has painted it. It is a shame that the H1Bs are being targetted. Especially, those who came here directly on the H1B were people badly needed by the economy then. Also, if you think about this particular group, the fact is that they have not been able to enjoy grad school or any of the big plusses of US college life. After coming to the US, all they have done is work non-stop. And they've earned their GCs now.

I just spoke to a NICE IO (really nice one who really took the time and was not pissed off at all the questions i asked).
Per him, the RD is what they go by. every month on the 1st when the lot is to be assigned to the IO they go by PD to see who all became current and then order them by RD in the ascending order (atleast this is what he told me).
Then I asked him, is it not unfair for people like me from 2004 are at a disadvantage compared to 2006. For that he empathized with me and he said that they do not have any control over that and it is the DOS and he also mentioned about a few more callers from 2004 who called him and expressed the same concern.
Also it seems like there is a little bit of overlap coming from the month end. If some one is processing some applications from last month and he happens to have some leftovers from last month he would still process them even though they are not in order potentially causing some more discrepencies and that there is nothing they can do about it.
over all it was a good conversation even though i know the pundits on this forum may disagree with him as much as i do, but i hope there is some truth to this and hopefully there is some order than no order.
praying to gods almighties (hopefully there is more than one and that they are good republicans or good democrats supporting my cause) and all those above me to shower me with 2 Green cards one for me and one for my wife
Are they IO's who answer our call's or Just Customer reps just like any other credit card or bank coustomer reps?
I consider IO is the one who process the applications correct me if i am wrong.
