Your case is eligible the chances are high that you'll get it, if dates remain current. And as folks have mentioned, 180 days rule applies. Your infopass will tell you clearly what's happening to your NC but that is immaterial.
I realized your original question was about FP and its expiry and not about NC. - fill the complete i765 form, dont forget to sign
- copy of 485 receipt
- front and back of current EAD card
- 2 photos (make sure to write A# and name at the back using a pencil)
- check payable to US department of homeland security
- file it correctly to the right service center (dont worry if the address is different than what u filed last time)
- nothing else (since its a adjustment of status case, there is even NO need of i94)
- Just make sure A numbers are written properly everywhere.

I have applied for my Son's PIO at NY and I have not notarized the copies. They verified the originals and returned back to me at the counter. You don't need to notarize copies if you have the originals with you.

In light of the AC21 provision, this is pretty common - people change jobs using EAD and are then on AOS. Looks like the wording on AP was ignored when AC21 was being made into law. This is now biting some of the travelers.

AC21 is nothing to do with AP. In AC21, you are changing the job WITHIN US, not leaving US. There is some securty related reason, for requiring one must not leave USA when AOS is pending. AP is for a short emergency travel during AOS. Yes..it will be a pain if AOS takes many years, particularly travel issues.

I was debating the fact that we need to ask India government to device some sort of parity between Capital acceptance from U.S. firms. It takes us, who respresent Intellectual capital, 5 to 6 years to get some kind of permanent residency in U.S. and that too in a grudging manner. Why do U.S. MNCs demand immediate clearence of their projects and complain about delay etc. If you look at comparative delays, Indian system is still light years ahead of so called efficient American system. Its just that we need to look at things from a correct perspective. Monetary capital needs to be treated at par with Intellectual capital. Just a thought.

Also, the current visa numbers are 9800 for a country annually. That limit goes down to 9000. Its a 10% cut but is that going to have major impact on retrogression?

No votes for 2003 and earlier. If this sample reflects reality, thats good news, dates should not retrogress too far back. Quite a few 2004 cases, but with the dates for them going current next month, hopefully many of these people get approved, and the queue moves ahead...

My lawyer advised against filing AC21 proactively. His opinion is that it may trigger a big RFE requiring financial details of the new employer. How true is this? I have a feeling my previous employer might withdraw my approved I-140 on the advice of their corporate lawyers (Fragomen, who I believe recommend I-140 withdrawal as past of their standard procedure when an employee leaves). I would like to preempt that and file AC21 documentation.
Yes, most Attorneys advise against proactive filing primarily because AC21 has no formal process associated like form, fee, reciepting or standard. It is based on guidance, most times the AC21 docs may or may not reach your file.
Some Attorneys advise the HR to proactively file for AC21. There is one company (huge) where when you are being offered a job on EAD after AC21 - the HR dept makes a big fuss - asks for all documents like copy if Labor, 140, 485 reciept any any other documents and then makes you sign G 28 and then file for a G28 change in Attorney and associate AC21 docs with those. I guess, the Attorneys charge money so it is a business. If RFE or denial - then more money.

I applied for EAD renewal sometime in the end of May and I received my EAD cards both for me and my wife yesterday valid for one year. OUrs were expiring in September 2008.

It would be great to have premium processing for 485s instead now that visa nos are available. Now now ... i know thats wishful thinking but think about it-could save a lot of time and money over EAD/AP/FP renewals. But then again hurts their income stream thats why they wont do it :((
