Folks...it looks like I have been given membership to this exclusive club, by USCIS...:)
My status on USCIS Online case tracker shows,
"Current Status: Fingerprint fee rejected and notice mailed; case in suspense."
When I spoke with my attorney, he says, There are two options.
1. I can dispute and in turn get my processing delayed
2. Repay the fingerprint fees ($70) and forget about my first payment
Naturally, anyone would prefer option - 2.
Just wanted to share with you all...

I have listened to the three main "Conservative" talk show hosts, Michael Savage, Sean Hannety & Glenn Beck. They are just like politicians and will do anything to retain their popularity. They are experts at twisting sentences and putting words in the caller's mouth. And when they feel they are losing the discussion, they start shouting 'GOMP' (Get Off My Phone) - very much like kids.
Sure they like the food, but thats where it ends. Their main audience is the WASP crowd.
It's better to avoid. Plus what do we stand to gain - hardly anything.

Maintaning F1 status while I-485 pending is not a clearly defined area by USCIS. There are some resources I provided in the following link. There is no definite answer for this.

Thanks for your suggestions.I checked with my Lawyer about the job title .she says job responsibilities matter in this case.Job title is for any company's internal designation it seems.
I don't know exactly what AC 21 regulations are.I just want to follow any best Lawyer's advice in this matter.
The term Technical Recruiter is very generic This job can be done by any person who doesn't have any technical background .But If a person with good technical skills will bring more value to the company.
The area which i'm focussing is basically IT Sales.Company which is offering me this Technical recruiter position is impressed with my technical back ground and hiring me.They are actually looking for some one who is very senior and having good amount of experience with Technical back ground specially ERP Packages.The role is also not confined to just recruiting but meeting the clients and bidding the tech support and new impementations for the company.
I personally see lot of career growth in this path.But unfortunately there is nothing one can do in this matter.

Response: The AC21 rule and the EB-5 Special Class rule are both undergoing revision and should be published in the near future.

It's important to have the goal clear. Trouble with "Truth based Stories" is that they deviate very soon from the truth & start focussing more on the aspect of entertainment (American Gangster as a recent example). I don't like the idea of diluting the subject to make it more entertaining.
Entertainment means different things to different people. There has to be a target audience in mind before making a movie. The larger the target audience you focus on, the lower the common denominator becomes. This is the reason Lou Dobbs has a bigger audience than Bill Maher.
I think the idea of documentary is more true to our purpose even if it may reach fewer people.

Folks. I am planning for India vacation this winter.
I have a quick question. Please let me know your opinions.
My H1B stamp expired a few yrs back. I have an approved I797 valid till April 2008. Can I travel on this AP and come back and be on H1B? Do I have to use EAD(once I come back from India) if I use AP?

But keep writing and keep calling. They might listen.
Its called a form-letter.
The staff writes those.
They use the same letter and change the name and address of the constituent and copy-paste the generic position on immigration.
That is the reason you are seeing a letter that casts a wide net on immigration issues, like border security, illegals, etc. etc. The staff would send out the same letter to all constituents who are writing for or against immigration or any issue related to immigration.

Did you fill the actual I-485 forms or just the questionnaire that employers usually send? in case you've filled actual forms that they will send, did you check the box on the right bottom where it asks if you'll be represented by an attorney...
In case of a questionnaire, you might get those forms filled by them for your signatures.

this is compeletely voluntary. I have contributed $50.00 so far. I think good way is to create spreadsheet showing member names and contributions, make link to it. Whoever wants to see, they can always look it. But I think we should not make it mandatory to contribute for becoming a member. Any advice / opinion is valuable for IV.

Not to single you out, but why aren't people from the West willing to attend the rally?
1. Too much workload (cannot afford to take even 1 day off)
2. Cannot afford flying into DC, accomodation, etc.
3. I didn't attend the SJ rally, what will they say if I attend the DC rally;)
4. DC Rally is a waste of time, I do not support it
5. I don't have to have a green card, I can live without it, for the next 10 years!
6. I am happy to eat the fruit of someone else's hardwork, I don't want to put in any hardwork myself

2) If my I140 denied and her EAD become Void, Is she permitted to stay in USA or She needs to go out of country and enter with h4 status?

Yes, You can use EAD and start working on it before I-140 approval BUT you can not change employer using AC21 without an approved I-140 even if your I-485 is pending for more than 180 days.
Let me clarify some doubts people have on this thread...
It's your choice whether to use EAD or H1 to work,
You can change employer on EAD as well as H1(EAD is just easier, no application fee involved), provided your 485 is pending for 180 days and 140 is approved.
EAD does not give you the freedom to change employer if the other 2 conditions are not met(140 approval and 485 pending for 180 days). Once these 2 conditions are met, you can change even on H1....

just a guess, they must be pre-adjudicating - pending a visa number. So, looks like (again a guess), if they pre-adjudicate before the FP expiry date, then you are good, otherwise, they will ask you to go to FP again...

ask lawyer to file MTR and resend response to RFE along with it. You should get a quick response (within 4-6 weeks). If MTR is denied, ask to file appeal, but sometimes it's better to change employer and start from scratch. Appeal can be a long process.

(I filed my AOS on July 2 at TSC)
TSC has officially progressed to 6/30 so the July filers should now start receiving their receipt notices! But the question is, what do we do after we get them, or in the worst case, if our AOS got rejected? There is nothing you or I can do at this time... the deadline to re-submit is over on August 17th.
The root cause of the whole problem is retrogression & country caps, and unless we speak up about it in one voice, no one will do anything to fix that root cause!
So keep looking at the road as you drive, but also take a moment to look beyond the next 1 mile... where there is a traffic jam in which you and I will get stuck for the next 5 to 10 years... unless we do something about it.. together!
So, please take a break from tracking receipts, and decide how long you are willing to renew EADs and worry about following the complex AC21 rules & regulations. If you are like me and not willing to do that forever, then make up your mind and attend the DC rally!

He will be out of status. Your 3 year extension beyond the allowed 6 years is based on that LC/I-140 from which your I-485 was filed. If the I-485 is rejected you have no right to stay beyond 6 years....
Total BS and Incorrect.
One can work on current H-1B (irrespective on basis it was approved), until the H-1B petition is revoked or canceled or expired. However, beneficiary is not eligible for new/extension of H-1B after I-485 denial.

Canadian Border is like an hour nad half drive for me. I can drive up to border but i don't have a canadian visa. So i will be denied an entry and if i return back will i get a new I-94?

Generally when you are travelling by road to canada they do not issue new I-94s. You have to be in Canada for atlease a week or so to ask for a new I-94. I travelled on business few times. They never gave me new I-94s saying I have been there only for a night. I think, the I-94 attached to your H1 extension should be valid till that H1 expires.
Years ago(1999), my wife's I-94 expired, because at the airport the immigration office entered wrong date. We never verified. We were going by the H4 validity. After the expire date, I spoke my lawyer he was prepared to file for new I-94 but asked for 750USD. I went to the local immigration office in Boston and they corrected it without any issue.
Very recently as last week, we were coming from Canda after spending a week. We crossed the border by ferry, my wife's passport is due to expire in couple of months, her current I-94 is valid for 2 years. We told the office that we do not need a new I-94 and he was OK with that.
So check with the local immigration office, but only after getting a new passport.
