USCIS has F1 file. If it illegal to apply for PERM while on F1, why did USCIS not reject PERM?

USCIS cannot reject PERM as USCIS has nothing to do with PERM. PERM is done by the dept of labor, and this agency is not part of USCIS.
In terms of PERM, PERM is not considered an "immigrant petition" and thus would not be deemed as violation of status. PERM is berely the assurance there is no workers who want to take the job in the position beeing sought. Note, that when you go for a visa, one of the questions asked is, Have you ever filed an immigrant visa petions, or has an immigrant visa petiion was ever filed on your behalf?"
The law finds an immigrant petion only when one applies via I130 (family based immigrant petition" or I140 (employment based immigrant petition). Only filing of IMMIGRANT PETITION would constituate a violation of one's non-immigrant intent and status.

My case is as detailed below, and my questions follow:
PD: July 2007, EB2 (India), Software field
Labor, I-140: Approved, I-485 etc. NOT filed.
H1 Petition and Visa valid until: Jan 2011 (after 7th year extension)
Currently outside US, NOT working for the H1 sponsoring employer.
My employer has NOT revoked my H1 or I-140.
I was working for the employer in US where the GC process started. Then moved to Canada in early 2008 when the PD was highly retrogressed/unavailable. Since then, worked in Canada in related field for a different (Canadian) employer. Things have been tough here: lower pay, very high taxes, friends all in US, and especially - the weather. We would like to return to US.
I will soon be able to apply for Canadian citizenship. I am in a dilemma now - whether to return to US on H1 NOW or to become a Canadian citizen and try my options LATER. I have the following questions:
(Same employer, as Indian citizen, knowing that I did not work for them for over 2 yrs, and was outside USA):
1) can I now(or anytime until Jan 2011 visa expiry) return to US to work for the same H1 sponsoring employer on the existing H1?
Yes...you can as long as your employer is also supporting you
2) would I be allowed the H1 extension in Jan 2011 based on approved I-140? Or is that doomed to be rejected because I was not working for the employer in between for over 2 yrs.
GC is for future employement and it should not affect. You are already out of the country for more than a year. So your 6 year limit is reset now.
3) Would the fact that I was out of US for 2 years help me get a "regular" extension?
I believe it should not have impact as the six year clock is reset and you also have I-140 approved
4) could I continue the GC after a gap of 2 yrs while I was not working for the employer?
Again, GC is for future employment.

Yes, if I-140 is not revoked. Different attornyes have different opinion about revoked I-140

If your H1B is not expired, you can do transfer. I am not sure about the limitation if the H1B expired.
7) For the H1 "transfer", would I need to produce US paystubs for the last few months (which I cannot, since I am not in US)?
You may need to provide the W-2 for the years you were working in the US
8) if the new employer applies for my GC, could I re-use my old PD of July 2007? If yes, would the profile need to be exactly the same as the previous Labor/I-140?

If you are not married before GC, you are in a crappy situation. If you marry you will have to deal with lots of mental misery, distance, stress etc. Not worth the pain. You can look at this option - after GC, you are allowed to stay outside the country for a max of 1 year without a permit and 2 years with a permit, without affecting your GC status. The flip side is your citizenship is delayed and you are similarly delayed in sponsoring your spouse. Also, it is not a good idea to stay out more than 6 months at a stretch in any calender year so that your citizenship is not affected. Maybe it would be a good idea to join lobbying efforts to allow sponsorship of immidiate family of GC holders. Lots of people are in this situation. Without a GC your professional life is screwed and with a GC your family life. Good Luck.

Been with Ron Gotcher for over 5 years now. Never ever had a problem. The best thing is you can talk to him or his son anytime regarding any immigration issues. I had lots of H1 issues with my current employer and he was gracious enough to talk to my employer several times and help them out without charging me a penny. I would highly recommend him.

Background : EB2 India PERM applied in Oct'08.PERM RFE Audit notice received on Apr '09 and replied immediately by the lawyer. Currently as per iCert labor website Audit cases being processed as of 07/31/2010 are PD July 2008. My H1B six year completes on Jan 2012.
Question :
- When do I realistically expect any decision on my PERM audit?
- Should I apply for fresh PERM Labor in order to meet the 365 days prior labor applied rule for H1 extensions or should I wait for the audit to be decided? My spouse has EB2-I PD OCT '07 with 140 approved ..waiting to file 485.
- In case I decide to wait,what will be my status if the pending PERM currently under audit filed gets denied? What are my options for further H1 extensions in that situation?
- If advised,when should I plan to file my fresh PERM labor? Given that a RIF took place at my employer at end of May 2010, per my understanding there is a six month wait period after RIF to file for PERM labor. The Process of giving Birthright citizenship is a law called Jus Soli(14th Amendment) which was implemented in 1900's . Numbersusa and others are fighting to change the Jus soli to jus sanguinis which gives citizenship based on the child's parents Status to reduce the "Numbers".India Abolished Jus Soli in 1987 and dosent offer Birthright citizenship. I think going this Route to discuss the possibility to fight for parents naturalisation based on child's status will make us no different from Illegal Immigrants.

Labeling children like anchor babies is dehumanizing. I believe that when kids are involved, as human beings, everyone should always be concerned about their best interest rather than what our political view.
This is why I hate the term anchor babies. The antis are willing to even dehumanize kids if it fits with their political view.

My wife will be on H1(currently on H4) october onwards...we received our EAD's yesterday. Can I still go and apply for SSN? I mean will that mean she is on EAD and H1 no longer valid?
In my case my wife was on H4. She had to activate EAD to begin working. For that reason she applied for a new SSN.
Based on my limited knowledge, if anybody activate's EAD and begins working on that EAD, they'll lose their H status. Experts need to confirm this.

I will next month. Using same/similar job. And also, my lawyer said that we do not need to send AC-21 letter to USCIS, wait for the RFE, if any. So don't worry and enjoy this small freedom.
