We traveled through Frankfurt airport using AP yesterday on Air India flight no Transit visa..... No problem at all ....... Frankfurt airport gate security officer asked me for AP specifically when I said I do not have visa stamped on passport..... So I assume it is ok to travel on AP.....

Retrogression was always a law. We only got caught in it. Retrogression has happened in the past (1997-98). Its affects are severe and noticeable this time because of large number of H1B filers from India past year 2000.

So it seems NSC is processing either based on PD or random. Not based on RD.
I spoke to rep at NSC today he said my case is clear and just waiting to be adjuducate based on RD..but when i asked him about the name check he said he do not have an access to that however he again said the nothing is holding up my case just a matter of RD...so what can i interpret based on this is my Name check has been cleared or not?:confused:

I landed in Canada as a PR on Apr 4th. I had to return to the US to finish some stuff before taking a vacation and the experience was unforgettable. At the US border office I was quizzed (more like beat up)for about a half hour. The US officer in charge made a copy of my Canadian Landing paper and said that I can't have residency in 2 countries. He said that he was going to stop my residency process in the US, in spite of the fact that I have not even started the US green card process (Labor certification pending) and had applied for Canadian PR at least a year before my employer applied for my labor cert (changed employers). I thought that he would refuse me entry to the US, but luckily after a lot of pleading that I need to finish things up in US, he gave me entry. I repeatedly asked the officer who gave me the I-94 as to what effect will this have on my 140 and potential 485 to which he replied "Your processing is done. You need to leave or we are going to call the cops"
So all of you guys/girls with AOS pending, beware, these are not good times to land in Canada with a PR. Heck, I've not even started my green card process, yet the guy gave me so much of angst and made the 1/2 hr a living hell for me. This is after I've lived 9 years in the US as a law abiding and tax paying person.
Now I believe those guys who say that POE officers are behaving very badly nowadays, given the economy. They've appointed themselves as "guardians" of the US from "invading foreign hordes" and interpreting the law whichever way they see fit. :mad:

(i) There are also other forums that discuss immigration issues some of these forums are a country/ethnic specific - members can visit them and mention about IV. I used to visit/contribute to a forum on grasmick.com. Its a volunteer forum of Canadian citizens coming to US to discuss TN1/GC issues. I mentioned IV several times there in Jan/Feb. That forum is not active anymore but its used to be very popular among canadians. I am guessing there might be several such for different regions and/or professions. Please share info, some of us can go there and tell about IV (more buzz means more people get interested).
(ii) There are ethnic TV/radio programs watched by immigrants. Worth exploring if they advertise our ad or mention us briefly. Some of these programs mention/advertise charity events for free. Members can explore this on their own and update here any successes.

I am shocked and very disturbed by the news I read about the new requirement for obtaining driving license in the state of Michigan which allows only Citizens and Permanent residents to obtain licenses.
I am a legal immigrant working in US since 1998. I have been living in Michigan since 2003 and own a home in the state. I am on a temporary h1b visa working towards by permanent residency. I have been in the process since 2002 with no end in sight due to tremendous backlog in this process. While we are waiting for our residency application to get processed, we are caught in a situation where we cannot claim to be permanent residents. We do not carry driver license from our home country anymore as I have been living in this country and driving with US license for 10 years.
I do not know what you expect us to do in this condition. This is the first state in the whole country with such a requirement. Every state I have lived in gives driver licenses to legal residents for the validity of their Visas.
I hope you understand the problems legal immigrants will face due to this new requirement and make necessary changes to allow legal residents to obtain licenses to work and live in Michigan.

I talked to IO and according to her, applications will be processed only if the visa numbers are available. If all applications have been processed for which visa numbers were available than they will process by RD. So, even if the cut off dates for processing the applications is July 16th at TSC, they will be processing only EB-2 applications based on RD till end of August. As and when the application processing is complete they will be assigned to IO and visa number allocated. If the processing dates are past receipt date than they will be given visa numbers shortly.

You will see that when a question is answered; then it starts everyone thinking. Issue identification is the most important thing that the immigration boards have to offer.

I don't come here just to read about the things that I already know, but to learn about the issues that someone else is facing and how they were resolved, in case I were ever to face the same.

Isn't there a risk in filing I-485 on your own? Can anyone share their thoughts? What if you get RFE's?
