    Please let me know your thoughts..
    I-140 is approved. I-485 was filed in July 2007. I have an opportunity to move to another company for a similar job profile. But the new company wants me to work as a contractor (hourly) on W2.

    Is that a problem when filing AC-21?

    Please advise.

    USCIS has specified that they would have processed all the records into a single database by 29th October.

    Does this not mean that there could be a forward movement in the Nov bullietin ?

    Based on this (although not sure where USCIS posted this date), the DOS wouldn't be able to use that data till the end of October (at the earliest) or early November (likely). Meaning that the December bulletin (issued ~mid-Nov) might be the one to watch for any movement (forward or backward).

    i am looking for help in wrongful i485 denial of 485 with ac21 .

    Below is my situation .

    Company a :
    Pd: 12/31/2003
    category : Eb2 india
    labor cert approved : 3/30/2004
    i 140 rd : 4/13/2006
    i140 approved dt: 9/21/2006
    i 485 sent : 7/2/2007
    i 485 rd : 7/5/2007
    i485 nd : 7/13/2007
    finger print : 9/2/2007

    company b :
    Joined date: 2/14/2008 (after 6 months)
    filed ac21 by company attorney
    contacted congressman's office when pd become current for more than a year but no approval. Got response that it is pending in extended review.

    Left company b to move south side because of health issue ( winter) .
    Company b understood the situation and left in good terms with them.

    In theory, the idea that a gathering of even 200 people in company's parking lot (Cisco, goolge, microsoft) - IS GREAT.

    Immigration Voice has always appreciated efforts of members who get employers involved.

    However, I am inclined to believe that company HR will resist such activity on their own premises, especially during business hours or even lunch time. That's because its loss in terms of productivity and distractions for all employees, even those who are US citizens.

    BUT...

    If someone pulls this off and if there is a gathering to protest green card delays at any of these companies -- Cisco, Oracle, Microsoft, Google, Intel, Amazon...anyone...THEN IV leadership will fly to such an even from wherever they have to fly and attend it at a moments notice (provided your employer allows us in your buildings/premises of course).

    Not only that, if you can pull it off, then IV will honor you will a "IMMIGRATION VOICE MEDAL OF HONOR" for doing that. Its a square medal with imprint of GC on one side and EAD card on another side. :):)

    So if you can, by all means, pursue that opportunity and email me or Aman on how we can help you do that. Microsoft has 3500 employees in green card wait line in Seattle alone. Cisco is also hundreds of employees in San Jose alone (and Cisco employees is one of my favorite groups of people in IV, they have shown up every where IV has done anything...must be something in the water out there in the bay area, its a land of activists...).

    not personal, addressing many issues.

    1. if your company pays for everything, why such reluctance to put up a few more dollars for your own cause? think of those that pay for everything themselves and still contribute.

    2. each contribution to paypal costs, they take a chunk off it. making small 10 buck contribution is really not the intelligent way to go.

    3. there used to be a 20/mnth recurring contribution. now it does no exist. what do you want? should we throw out the original 20 buck guys? of course they can continue doing it. i can't imagine why it would put you off? btw we did not really lose any money by going to a minimum of 50- you know why? those who were serious still contributed. others who were whining at that time (why is there not a 10/mnth option) were in many (though not all) cases not going to contribute anyway. this is just fyi.

    4. what is 50 bucks a month? step back and think sometime. a family meal/movie? do you indulge yourself occasionally worth 50 bucks?
    i think in many cases the answer is yes. the money we need for lobbying ie very large....it's hard to make it form 20 bucks at a time when barely 5% of the membership contributes.
    you have the choice hereof donating 100 now and considering it as two 50 buck donations, so your next one will be delayed. there are various ways of looking at this.


    there are various ways to contribute, money is just one of them- although very important. if you have not done this, join a state chapter and start meeting lawmakers in your area. get friends to join iv. put up fliers and posters in local grocery stores/fairs and festivals etc. there are many good examples of these activities being done successfully. in the end it's going to matter is whether we put enough effort to push over the line- whether it's today or in 2 years.

    we all have a choice. please make a wise one.

    Here is my dilemma--

    MY INFO---
    Occupation -- Physician
    EB2, INDIA, PD APR 2006, EAD renewed till sept 2010, H1 valid till feb 2010 (non-profit company), I-140 approved, I-485 filed July 2007

    I have a very good job offer and I really want to get out of my present job. They expexct me to start work next year in about apr 2008-- The new job is not in my present state but I am freaked out about using AC 21 for following reasons:

    -New company has no clue about H1 and they cannot file H1 any way because they are "for profit" and my h1 is presently from non profit and the QUOTA is now over. My occupation still remains same -(I am a physician ---no way to change occupation -- still have to do same job !)

    -New company can only give me a generic letter for employment (EVL) ---
    "To whomsoever ---etc..it may concern..and only briefly describing my title and job description"

    --- My questions to respected IV members

    1) should I invoke Ac 21 ??-- I am worried that the EVL may not meet USCIS needs as it may not be fully detailed

    2) The other option I have is to take a leave of absence from my present company for one year and start working for the new company? IN this case what happens if I get RFE for EVL ? Which company should I say I am working for present or the future ? Also If I do take a leave of absence should I send in AC 21 paperwork or no?

    PLEASE HELP I am very confused--- I strongly feel that the leave of absence might be an insurance policy but I don't know how to approach it !!

    Why don't you do this? Try to search just for your employer - and once you have a bunch of cases filed by your employer, go ahead and narrow yours down based on Priority Date.

    I do have the Employer and Attorney details. I searched based on that. Reg, case number, which case number we have to use, the backlog center number or any other number? I do have a copy of the approval letter received from backlog center.

    Let me know what else I can do?

    When law abiding persons are prevented from gun ownership; crime goes up. Because whether it is legal or not, criminals always have guns.

    Actually very true. I for one have held off on buying a gun (though my wife highly disapproves of guns) simply because I dont have a GC and dont want any hassles. Besides I live in Chicago which has a ban on guns. Ironic that the maximum killings and drive by shootings happen maybe 30-40 blocks from where I live but the city doesnt allow legal law-abiding residents to own guns.

    Idea of sending cds, chips, to congress has been discussed last year.

    I am of the opinion that we should send helmets. (kids bike helmets).

    I suggest we initiate a campaign called "PROTECT THE BRAIN". That is protect the talent and knowledge of immigrants,

    I agree that we should send lawmakers something big, bulky, and noticeable.
    Something that sits in their offices, is personalised with different colors and notes giving the same message. I feel that books or cds can just be unattractive and not a big topic of discussion amongst the staff. (Ultimately it has to be something unusual to create curiosity and attract attention and discussion)
    So we send them helmets with our degree certificates/ message from IV pasted on it.
    Helmets will say "protect brains". Save the country from losing legal high tech workers.

    3. Insist that they follow the procedures outlined in the memo. Do not leave until they do what they have to do according to the memo. They have to provide you a receipt that they followed the procedures.
    4. Get your EAD within a week or so after infopass.

    Thank a ton for the help, Can you please tell in more detail what i need to do/say there? I have heard that people are being turned back pretty rudely at local offices. Also do i need to fill any forms before i go there?

    I agree, you will be competing with all the illegals. But.....

    1. How likely are they to file their apps on the first allowable day that USCIS will accept the applications? Not very. Most of us know what's going on and will be ready to send in our apps first. Ofcourse if some EB based guy is pottering around instead of moving fast, thats his problem.

    2. How many illegals can afford the high priced attorneys? Most of these poor guys dont know to speak, read or write english, forget about filing out USCIS forms.

    3. How many illegals maintain perfect records of their time and can recreate a paper trail of the time they spent in the US. I certainly can and most legal wannabe immigrants can definitely prove the time they have been here (paystubs, utility bills, credit card statements, bank statements, etc.)

    The point I am making is - this is the best option I have seen in a long time. Even the stupid point based system had its drawbacks. This is unconditional. It will get vast support from the hispanic community also. The UK has the same thing. Be on a work permit for 5 years and then you are eligible to apply for Permanent Residency. I believe there is also some clause in the UK system that states that you have to have been in the UK illegally for 10 years as against 5 years for a legal immigrant. I'm sure setting the illegal bar at 10 years and legal bar at 5 would be acceptable for most people.

    People who left employer early or want to leave early will say it is ok; because it suits their needs.

    People who plan on staying later or don't have any intention of leaving early will say to stay.

    Bottom line is it is upto everyones own risk tolerance. I have just seen some of the biggest cowards in terms of immigration all of a sudden get so brave after they got the greencard.

    If people are waiting years and playing it safe then what is the possible harm to wait a little longer and not get riled up by every small story of someone who got questioned at citizenship time, etc.

    Immigration laws don't change very often; however, uscis interpretations and memos do change quite frequently. When you have to start hiring lawyers, go to court, face uncertainty then we'll see how brave people are.

    As I see it, hiring a lawyer is still cheaper than losing 20K per year because you are working for a exploitative consulting company. But if the company is treating you well, there is no reason to leave.

    Dude,
    I am facing same issue....need to get some money back from India....and there is no way i can get it officially without losing significant part of it. It is really illogical to send money to India for property investment just because we cannot get money back.....I am repenting doing that....

    Whenever I ask my friends to do this favor to me.....all they say is they dont have money to send India (since they dont want to disclose their worth to me) or they dont want to send money to India since they know it is useless to send money at such a bad conversion rate.

    If you can find some better way, let me know too.

    We are working on 3-4 amendments that reduce retrogression and help with backlog candidates with longer H1 extensions (Instead of 1 year H1b extensions).

    Please keep in mind the Core group has given 3 months of devoted time and its in core group's interest also to get things done.

    These amendments will go into the final bill before the debate is over and we will let everyone know the time/date details just a few moments before they are being introduced, if its possible to do that.

    The WSJ article was aimed with a different purpose addressing the republican candidates who have taken a strong stance against latino population and its election consequences. It would not have been good to get ourselves mentioned in article that has largely advocated illegals. We have been trying to separete ourselves from illegals. Remember???

    Regarding the media exposure for us, QGA has given us Roll-Call article exclusively for IV, NBC appointment(Siva was on NBC last week on Brian Williams) etc.

    Please be patient and trust us, we are in the same boat as you are and we would appreciate a little patience for a little more time please.

    The real problem has been the l1 visa..and ignorant americans do not know the difference and they think everything is h1b but it is the L1 which has caused wages to drop....

    Infact theres no limit on L1 quota like H1B.
