    The biggest stumbling block to skilled immigration reform has been the democrats, particularly from CA. They know that the more educated and high paid a person is there is less chance of them voting Democrats. Whereas illiterate farm workers and others with little English language skills will be a perpetual vote bank for those that where responsible to get them legal status. Because CA is overwhelmingly decmocratic, politicians tend to show their true colors. On the other side, deeply conservative North Dakota which has a population of around 600k, had a NEGATIVE growth of 1% in the the last census, compared to 5% growth in the US population (5 year period), BUT we had their democratic senator Dorgan, vote against CIR! How zenophobic can one get! That is how "local" the politics in US can become. The same goes with the deep south - the bible belt where support for both legal and illegal is tepid.

    Good to see us gaining some slow but steady momentum...So far we have these users that have agreed to help us in this effort.

    myself, indianabacklog, thomachan72, rego, yvjoshi100, legal_alien_007, sri1309, Pandi, Openarms, domainguru, rameshvaid, teachamerica07.

    The other users have given positive feedback but have not directly mentioned that they will participate yet.

    As someone pointed out earlier, most people here on IV may not know about 'aging out' and the plight of families and children stuck in this situation. And if they do, they do not have direction to help you. It is plain ignorance and not unwillingness to help.

    I would follow recommendations by pappu to make concrete efforts, in addition I suggest -

    1) Call your cause 'WHAT ABOUT US, DREAM Act?' Type a brief background of what aged out means and how if affects LEGAL families. Brief written and YouTube stories of all aged out children and the hardships they are facing.
    2) Request IV to make this a sticky so that it is on the front page of the forums and does not get pushed down.
    3) List your plans and how IV members can help reach your goal.

    Only a multi-pronged strategy with a single focus can achieve this result. Do not be disheartened that there only a minorty of people in your situation. I am sure once people understand the extreme hardships like 'rameshvaid' sending kids over to Canada, losing 2 years of education and discrimination by the proposed DREAM act, this issue will gain momentum.

    This is not the time to be anonymous sufferers, this may be your one shot to get the language in the Dream act. Open a blog on IV, sell T-shirts or whatever it takes to get more publicity. This is America - you get noticed if you stand out and catch media attention to jolt people into action. Try to get your story to some reporters and tie it to the DREAM act.

    I will help in any way I can.

    Normally I am very optimistic but this proposal is very big one "In order to accomplish this goal, a green card will be immediately available to foreign students with an advanced degree from a United States institution of higher education in a field of science, technology, engineering, or mathematics, and who possess an offer of employment from a United States employer in a field related to their degree."

    As according to this article (http://chronicle.com/article/Number-of-Foreign-Students-in/49142/),

    Some 671,616 international students attended U.S. institutions in 2008-9, an increase of almost 8 percent from a year earlier.

    So say 600K VISA's a Year will be big one.. But it will also help to take out lots of EB1, EB2, EB3 from current queue. .........

    In one line ... This is a Dream Bill.

    Not necessarily, out of these 600k, maybe 100k are advanced degree holders, and out of these 100k, maybe only 30k can find an eligible 'American Employer'. I am sure when publishing the details they will exclude all Indian consulting firms. But yeah even 30k sounds a lot. I believe they will change that to PhD from 'advanced degree'.That will use a few thousands extra visa, which is entirely reasonable.

    Guys,
    This bill will not affect any of the US High tech companies nor high-skilled immigration (it has nothing to do with EB immigration).
    Even big companies like Microsoft and Intel would not be affected by this bill (it is not as restrictive as the previous rule that firms that receive TARP funds could not hire H1Bs).
    No need to fear that this would be the start of something bad that we have to fight this to prevent future anti-immigration bills. No such implication.
    Although this bill borderlines indirect protectionism and interferes in the free-market principles, it is promoted to prevent fraud and may be to decelerate outsourcing by mostly Indian companies, given the current rate of unemployment at 9.5% and the increasing threat of widespread deflation.

    To be clear, I am not in support of this bill, but it would be a sheer waste IV's resources to fight this bill. If some guys can attach these kind of bills to other legislation, may be IV should focus on passing the visa recapture and may be increasing the per-country limit from ~7% to 20% (eliminating per-country limit being the most-desirable).

    Instead of fighting this bill, the least that IV could do is to focus its resources to eliminate the freaking diversity lottery program and allocate the 50K green card visa to the EB program. In this 21st century, there is no more need for diversity (which is line with the spirit of the past US Supreme Court rulings), everything is already globalized and flattened. Everything should be based on pure merit -- which is the American dream anyway.

    Immigration reform has become the first of President Barack Obama's major priorities dropped from the agenda of an election-year Congress facing voter disillusionment. Sounding the death knell was Obama himself.

    The president noted that lawmakers may lack the "appetite" to take on immigration while many of them are up for re-election and while another big legislative issue � climate change � is already on their plate.

    "I don't want us to do something just for the sake of politics that doesn't solve the problem," Obama told reporters Wednesday night aboard Air Force One.

    Immigration reform was an issue Obama promised Latino groups that he would take up in his first year in office. But several hard realities � a tanked economy, a crowded agenda, election-year politics and lack of political will � led to so much foot-dragging in Congress that, ultimately, Obama decided to set the issue aside.

    With that move, the president calculated that an immigration bill would not prove as costly to his party two years from now, when he seeks re-election, than it would today, even though some immigration reformers warned that a delay could so discourage Democratic-leaning Latino voters that they would stay home from the polls in November.

    Some Democrats thought pushing a bill through now might help their party. If it failed, they could blame Republican resistance, though in reality many Democrats didn't want to deal with an immigration bill this year either.

    Perhaps seeing the handwriting on the wall, top Senate Democrats released a legislative framework for immigration reforms anyway. The draft proposal, obtained by The Associated Press on Tuesday, called for, among other things, meeting border security benchmarks before anyone in the country illegally can become a legal permanent U.S. resident.

    By Wednesday, House Speaker Nancy Pelosi offered little hope that the issue was still alive on Capitol Hill.

    "If there is going to be any movement in this regard, it will require presidential leadership, as well as an appetite, is that the word? ... as well as a willingness to move forward in the Congress," she said.

    House Republican leader John Boehner was more blunt. "There is not a chance that immigration is going to move through the Congress," he said Tuesday.

    Rep. Luis Gutierrez, the Democrats' leading advocate for immigration reform, has said he voted for health care reform on the understanding that Obama and congressional Democrats would move a major immigration bill.

    Even though he would like to see Latinos turn out to vote for Democrats in 2010, Gutierrez said "many will probably decide to stay home." However, he added, a strict, new immigration law in Arizona may change that dynamic. The law requires law enforcement officers to question anyone they suspect is in the country illegally.

    "On one hand you are not going to vote because you don't believe people you voted for are doing a good enough job," Gutierrez said. "Then you say, 'I got to vote, because the enemy is so mean and vindictive, I got to get out there.'"

    Came in Year August 1998 on Student visa and passed in 2000. And finished with Masters degree with Thesis option (It is tougher than just passing the courses and taking a ME degree). Taking that option to prove something in life by taking research and feeling of achieving great in my prime youth. On the same time, other students from the same batch just took courses and joined the job market.

    Passed with great hopes and got a job in a US company with good promises. The company closed in technology bust. Took the safe route and joined an education institute (2001) Applied for LC in March 2003. No further process on LC until July 2007. Missed the great hope of filing 140 and 485 in year 2007. Finally got approved for LC and I-140 in June 2008. Waiting to file for I-485....Someday...god knows....Meanwhile, adding more and more degree in the bag...Now already have BE, MS - US university(2000), and MBA US university (2005). Can not change the employer as no H1B available and no EAD...

    In the great hope of GC�I have used the youth in hard-work, great planning while following all these ridiculous immigration laws.

    Staying with the same company since year 2001.

    Answer to original poster: Your 3 year B.Tech is absolutely eligible for EB2, provided if you have at least studied 4 years in accredited college/polytechnic to receive your terminal B.Tech degree, after 12 years of high school diploma. There is a difference between combination of education and pattern of education. Your�s falls into different pattern of education. So, you are fine. I am one of the classic example successfully got 140 approval from NSC in EB2 after a RFE. Mine also 3 year B.Tech. Do not spend money on education equivalency evaluation. USCIS do not care even if you submit 10 evaluations from different companies, they do not recognize. Fist, edu.evaluation is opinion only. It is not a binding document. Gets a letter from your school explaining the education pattern. It is more efficient. I did the same. They approve my 140 on the same date they reciived my reply.

    The entire education equivalency has been screwed up by desi companies, desi workers, education evaluation agency and of course lawyers. USCIS had been very flexible till last 5 or 6 years. Because of substantial abuse, the USCIS had become stricter on the education evaluation. Peoples try to combine any degree (like 3 year b.com and 1 year PG diploma) to arrive at equivalent to 4 year BS in computer science. I have seen a post by one guy got a evaluation saying that his 3 year BSc in geography + 1 year computer course in NIIT/Aptech equal to 4 year BS in Comp.Sc. USCIS is not stupid to accept this is equivalent to 4 years computer science. I am not undermining any degree or school. Because of so much abuse, genuine guys like you and me I got affected. Though I studied in highly reputed schools, I got RFE in 140. It was a big surprise for me. It took tremendous amount of time/money/energy to overcome the RFE, though I graduated from one of the top 10 engineering school in India comparable standard with IITs.

    Do not worry.. It will be alright..

    My attorney went ahead and filed under EB3 and got the approval (PP).

    Now I have to convince them to process them to file another PERM LCA for EB2. I am on 8th year going to 9 , so at least I can get 3 year H1 with this.

    * There are a large number of youngster immigrants in this country who have been brought into this country by parents either legally or illegally. They were brought into the country when they were children mostly involuntarily by their parents. As time passes, these youngster assmililate into "Americans" and turn into "American kids" in terms of their behaviors, mentality, culture, and value orientation. These youngsters face one common hardship to return to their mother countries. Culturally, socially, politically, and economically they have turned practically "foreigners" in their mother lands and cannot successfully build a life and survive economically and socially in their countries because they are considered strangers to fit into the stereo-type cultures in these countries.
    * In order to give a relief to these youngsters, the Congress passed the Child Status Protect ion Act (CSPA) for the "legal" accompanying children of legal immigrants and the Congress is about to debate and consider the so-called "DREAM Act" bill to relieve such innocent victim "illegal" youngsters from the hardships. As noted earlier, both of them share one common feature: They came to this country not at their choice but parents' choice. As the new Administration and the new Congress are about to initiate the Comprehensive Immigration Reform debate, one of these two groups starts receiving increased attention for their legislative relief, "illegal" youngsters, in the form of a piecemeal DREAM Act legislation or in the form of Comprehensive Immigration Reform Act legislation. These youngsters deserve such legislative relief and we fully support the DREAM Act initiatives.
    * However, we want to call the political leaders attention to the predicament of other youngster victims from the nation's broken immigration system - legal youngsters who arrived at this great nation not on their own volition but the decision of the immigrant parents. As time passes, some of these legal youngsters who are practically "American kids" face the difficult destiny of a potential forced departure from the country to their mother land because of the flaws in the current CSPA. The problem starts to surface as they approach the age of 21 because of the increased visa number retrogression and the increasing backlog in processing of the green card applications. The CSPA gives relief to certain youngsters even after they reach 21 years of age, but there are some group of these youngsters who are not eligible for such relief beyond certain limited period of time when their opponuties for green card applications will have to be terminated because of the flaws in the currest CSPA. These practical "American kid" legal youngsters will soon have to be separated from the parents, siblings, close relatives, and friends, completely uprooting their lieves in this country because of the potential forced departure from the U.S. The hardship does not end here for these kids. The real hardship will start from the time these kids are forced to depart from the country and after their arrival at their mother lands. Since culturally, socially, politically, and economically they are strangers with not roots whatsoever in these countries, not to mention the language barriers for some of them, they will have to face a difficult issue of survivality in their "practical foreign" mother lands. At the personal and individual level, this can be a real challenge and threat and almost insurmountable hardship which is caused by none other than their parents and the legal system in this country.
    * As the country is about to debate the fate of the innocent youngster victims in the immigration process in the form of DREAM Act and the CIR, the political leaders and legislators should not neglect the other grouip of these "voiceless" innocent victim legal youngsters from the perspectives of correct public policy and humanitarian considerations to give an equal shake in the comprehensive immigration reform.

    On behalf of my parent who is currently indisposed, I - a High School student - called every Congressman on the list. It was a very interesting and a positive experience. We at IV are close to achieving our goal, and we are going to succeed in this endeavor. However, even though the end is in sight, we must not let down our efforts in these final steps towards the finish line. I urge everybody who has not called the Representatives to do so. IV will be victorious.


    I hope we have more active members like you. I talked to and informed and in fact insisted to some of my co-workers to call, and none of them did - thinking that others will do. Such attitude will prolong our suffering.:(

    Thanks for the support. Slowly but surely the number is growing. Before we proceed we need clarification from seniors/core/experts who have dealt directly with EB issues, that our effort will not and is not in anyway contradicting / harming the general IV agenda. We are pretty sure that is not the case, particularly since we had some administrative level encouraging comments for this movement. Once we have this thread really energized and moving we can with mutual discussion and consultation with core decide upon the effective course to take. That might involve calling a particular senator or group of senators along with contacting media. This might involve donations (particularly to get core support to the max) from those of us who have not contributed much so far. Whatever the option, the initial goal is to get more of us into this thread and action NOW!!
    LET THE EB KIDS CONCENTERATE ON STUDIES/SCHOOLING, WE THEIR BROTHERS/SISTERS/PARENTS WILL FIGHT FOR THEM.
