Thanks for the sharing the data. But the data IV got from USCIS looks to be completely false. Did IV pay for this data, if so then please ask for the refund. Any way because of IV the DATA is in public domain.
    Dear ImmigrationVoice members,

We are sharing details of the FOIA campaign results. USCIS had given us the data that our members had requested but we had concerns about the correctness of the data. The backlog numbers were very low and inconsistent with the overall backlog information we had from other sources including previous USCIS documents that are publicly available. IV contacted USCIS and USCIS said that the data given to us is correct. However at that time we decided to hold off releasing this information in public and avoid any confusion within the community until we get further clarification about the data received. We also weighed various options of action against USCIS and thus did not want to do a public announcement of the misleading data until the matter was settled. When USCIS published the data this week on their site we were able to easily compare the numbers and see how much the data was different. Even after looking at the data on USCIS website we have some unanswered questions on the data and we wish to seek clarifications. IV would keep members updated on this thread any further information we receive from USCIS.

We are happy that USCIS made this data available to the public. Until now such data was not available to the public and we do not know if anyone had requested it in the past. It is all due to the members of Immigrationvoice who contacted USCIS via hundreds of letters and contributed to the FOIA campaign that helped release of this data. The other good news is that USCIS would update this publicly available data on regular basis. Our community should feel proud of this accomplishment.

At this time we have created a tool for our members to compare both data provided by USCIS and see its results. The basic difference is as follows:
    FOIA / USCIS
    EB2C- 4111 / 19,333
    EB2I - 9117 / 47,728
    EB2M - 26 / 211
    EB2P - 82 / 510
    EB2R - 1716 / 7,150
    EB3C - 1166 / 6,343
    EB3I - 8681 / 62,607
    EB3M -- 657 / 7,878
    EB3P 1624 / 11,563
    EB3R - 5779 / 62,840

Please review your line in the queue based on these 2 tools.

Based on FOIA data released to IV by USCIS http://immigrationvoice.org/tracker/waitimesUSCIS1.php

Based on data available on the USCIS website http://immigrationvoice.org/tracker/waitimesUSCIS2.php

Note: In order to view your number in the queue, please make sure to complete your key profile dates http://immigrationvoice.org/forum/profile.php?do=editprofile for the tool to calculate.

    Thank you for your support

    Pappu....

Do u think the statement regarding giving residency for folks with advanced degrees such as a MS, PhD, etc and a job offer from an american employer has any relation to the category that a person's green card was filed under.

Personally, i have an MS in comp sc, but if my category is EB3, i wonder how that will play out.

    Any insights you could share?

    Thanks.

Looks like, we are getting traction for this idea among us. We can try to do the same to explain this to Lawmakers. Thought from IV core group will be appreciated.
Now if we have a campaign targetting that 290k illegals are ahead of the legal and because of that legals have to wait that could get some good support. Most of the lawmakers will support this as they want their voting base to know that they support legal immigration and are against amnesty.

Hope this bill will fail in Congress, the business community will definitely block this.

Written to Congressman, giving the details to oppose the bill.

And also requesting him to support the EB-Visa recapture bill.

I am finding it extremely difficult not to be pessimistic but I think we are screwed either way (i.e. even if your 140 has been filed and approved before May 21, 07): PDs will start to retroegress back after this summer's temporary bump:
If the bill passes it will soon be excarbated by the 90,000 limitation (meaning only 90k of those 5/21/07 ppl will get 485s each year on a FIFO base -- the ppl who filed closer to 5/21/07 will get 485s 5 years later). Also, starting next year a lot of consulting companies will start/prepare for restructuring to meet the >50% on H1 dependancy for <50 ppl (Durbin-Grassy clause). This could mean a lot of consultants will be moved around among the parent company's subsidiaries which in turn will force those unlucky consultants to re-file... totally rendering the May 21, 07 advantage void. And even if that doesn't do it, the fact that H1 consulting will be banned will send most ppl packing home.

If the bill does not pass, current retrogression + namecheck backlog scenario plays out (i.e. 5-8 years for most ppl)... unless SKIL is slipped in as an ammendment to an appropriations bill - but do you really believe that's gonna happen? And even then this ponts-based B.S. could rememrge post-09 elections.

I don't know, maybe I am just rambling here. But I am just frustrated as hell as I see all my GC investments in terms of time, energy and money going down the drain. Does anybody see a way out of this?

If this bill passes in its current form , only way I see is getting a Z1 VISA and work on masters and may be PHD while on Z1 VISA and enter the bigger pool of GCs where there no country based caps.

If I were you, I wouldn't attach this letter from the University. Rather prefer to go with the evaluation that you had it done.

At times it is best to keep things simple.

    Good luck.

    Thanks for your advise arunsush!

I remember reading from one of the IV members that they sent this kind of letter and their case got approved.

I am thinking, once I get the letter - I will send it to my attorney and discuss with her if this is good or not. Any one else has any advise?

    There was no voting.

Apparently, IV members testified in front of MI Senate presenting a case for changing the MI law allowing driver's licenses to high-skilled immigrants. Someone is standing up for all of us, I don't know the name of the IV member who testified in MI today. Does anybody know the details?

Here is another suggestion: a lot of members here will have their own webpages or blogs. How about putting banner ads of IV on those sites with a link to IV. I have created 2 banner ads in vertical and horizontal sizes that can be posted. IV team, if you like you can post it on the publicity page. Let me know if you you would like to make changes to the text on these ads and I can send another version.

The 2 banners are in 180x150 size and 728x90 size. This forum does not allow files to be posted beyond a certain pixel dimension, thus I am posting a zip file too.

Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."

lot of so called american consulting firms utilize H1's (maybe not so much in the current env, but it'll start again) so this bill does not affect them only the foreign companies? looks like they are trying to level the field here and to fill the coffers.
What next, impose 50% tax on foreigners?

AFP: US Senate passes border security boost (http://www.google.com/hostednews/afp/article/ALeqM5hpS6ZKo4wAryQNsBY9i7PxjF3F7g)

A summary of the bill said the funds would be raised with a 2,000-dollar per visa increase in the price paid by specific companies for non-immigrant "H1B" visas for highly skilled workers or "L" visas for intracompany transfers.

"We're talking about foreign companies that more than half of their employees" are on those visas, said Schumer. "All we're saying is, you're going to have to pay more for those visas."

"This is not going to affect American manufacturing. This is not going to affect American jobs. What it's going to do is hopefully create some vacancies for Americans at some of these higher skilled jobs that these companies -- foreign companies -- are using the visas," he added.

03/29/2006: Advanced Degree vs Doctoral Degree, and EB Cap Exemption vs Special Immigration Benefits

Both Frist bill and Judiciary Committee bill include legislation to keep or bring in the brightest to this country. Both of these bills were intended to incorporate another pending legislative bill, PACE Act. However, in the process, Sen. Frist and Sen. Specter made some changes. For these reasons, people are very confused about the scope and parameter of this legislation when it comes to the eligible brightests.
First, there is no definition of "Advanced Degree." Neither the current immigration statute has a provision defining the term. However, the advanced degree is defined by the immigration regulation to mean 'Any U.S. academic or professional degree or a foreign equivalent degree above that of baccalaureate.' Simply put it means a master's degree or higher degree.
Advanced degree thus encompass both master's degree and doctoral degree. However, PACE Act attemps to distinguish between the U.S. doctoral degree holders vs. non-U.S. doctoral degree holders. Additionally, the Act distinguish U.S. doctoral degree holders vs master degree holders (both U.S. and foreign earned) when it comes to the specific benefits.
Close reading will reflect that U.S. doctoral degree holders will benefit from special immigration process without labor certification but they will be subject to the annual EB cap. Meanwhile, advanced degree holders (including foreign degree) with three years of qualified employment in the U.S. or advanced degree holders with the National Interest Waiver will not be subject to the numerical limit in immigrant quota, but will be required to go through the labor certification or other immigrant petition process. Consequently, PACE Act decided not to give both benefits of exempt from numerical limit and special immigration procedures to eiher U.S.doctoral degree holders or advanced degree holders. The legislative intent behind these provisions is not made clear.
However, the qualified brightest should read carefully these three bills (Frist, Specter, and PACE) and understand some variations when it comes to the details. Eventually, some more changes can take place on the Senate floor. We will keep readers posted of development of floor action on this part of the comprehensive immigration reform legislation.

hi everyone, Iam a july 2nd filer and our checks were not cashed yet and no receipt numbers until now. yesterday our attorney received our packages back from uscis. The reason cited for return is "you are not eligible to file for I485 as your priority dates are not current". This was dated on september 12th. There are 2 timestamps on the files cleary shown - one was on july 2nd showing they received and accepted the files. the second was on sept 12th with a return reason. surprisingly they didn't post the package until first week of jan. So the clerk who got the file to work on sept 12th just ignored the fact that the file was received on july2nd. My attorney has sent out this to AILA NSC Liaison to deal with.
